A little-noticed letter from Yahoo! to the US Marshals Service offers troubling insight into the surveillance policies of one of the Internet’s largest email providers.

In response to a Freedom of Information Act request seeking details of Yahoo’s! policies allowing the Justice Department to request wiretaps of its users and the amount they charge US taxpayers per wiretap — the search engine leviathan declared in a 12-page letter that they couldn’t provide information on their approach because their pricing scheme would “shock” customers. The news was first reported by Kim Zetter at Wired.

“It is reasonable to assume from these comments that the [pricing] information, if disclosed, would be used to “shame” Yahoo! and other companies — and to “shock” their customers,” a lawyer for the company writes. “Therefore, release of Yahoo!’s information is reasonably likely to lead to impairment of its reputation for protection of user privacy and security, which is a competitive disadvantage for technology companies.”

Yahoo! also argues that because their price sheet for wiretaps was “voluntarily submitted” to the US Marshals Service, it is exempt from the Freedom of Information Act law.

Verizon, meanwhile, says (letter PDF) they can’t provide details on how much they charge for wiretaps because it would be “confusing.”

“Customers may see a listing of records, information or assistance that is available only to law enforcement,” Verizon writes, “but call in to Verizon and seek those same services. Such calls would stretch limited resources, especially those that are reserved only for law enforcement emergencies.”

Consumers might “become unnecessarily afraid that their lines have been tapped or call Verizon to ask if their lines are tapped (a question we cannot answer),” the telecom giant adds.

Verizon also revealed it “receives tens of thousands of requests for customer records, or other customer information from law enforcement.”

Joe Wilson of South Carolina on the health care bill was identical to one by Representative Blaine Luetkemeyer and used language suggested by lobbyists.

WASHINGTON — In the official record of the historic House debate on overhauling health care, the speeches of many lawmakers echo with similarities. Often, that was no accident.

Statements by more than a dozen lawmakers were ghostwritten, in whole or in part, by Washington lobbyists working for Genentech, one of the world’s largest biotechnology companies.


E-mail messages obtained by The New York Times show that the lobbyists drafted one statement for Democrats and another for Republicans.

The lobbyists, employed by Genentech and by two Washington law firms, were remarkably successful in getting the statements printed in the Congressional Record under the names of different members of Congress.

Genentech, a subsidiary of the Swiss drug giant Roche, estimates that 42 House members picked up some of its talking points — 22 Republicans and 20 Democrats, an unusual bipartisan coup for lobbyists.

The wholesome Scandinavian image of furniture and lifestyle giant Ikea has been rudely shaken by a new book which claims the company is hostile to foreign employees and uses Stasi-style secret police methods to spy on its thousands of staff worldwide.

The explosive charges are made by a former senior Ikea executive Johan Stenebo, a Swede who started working for the company at one of its German outlets outside Hamburg over 20 years ago and rose to a senior management position. He resigned last year.

His book, entitled Sanningen om Ikea (The Truth about Ikea), contains wide-ranging allegations about a company which has become a global household name. Justifying the book to Gemany’s Der Spiegel magazine, he said: “I did not want to go along with it any more, but I could not stay silent.”

Mr Stenebo claims that Ikea, which employs 135,000 staff in 44 countries, is run with an iron fist by founder Ingvar Kamprad and his two sons Mathias and Peter, who were promoted to top management five years ago.

He describes Ikea as “one of the most secretive companies in the world” and claims that senior management were expected to show fanatical loyalty and devotion to Mr Kamprad. “There was an unwritten law for Ikea upper management: loyalty to Ingvar unto death,” he writes.

He alleges that Ikea used methods normally associated with former Communist East Germany’s hated Stasi secret police to spy on its staff and keep them in line. He claims that a close-knit network of company informers kept Mr Kamprad constantly updated on personal gossip about employees and the prevailing atmosphere in each office.

Foreigners who work for Ikea have been referred to by Swedish executives as “niggers”, he writes, and have no chance of being promoted to senior positions. In fact, most of the top Ikea jobs, he claims, go to employees from the town of Älmhult, in the Samaland region of Sweden, where Mr Kamprad grew up. Mr Stenebo claims Ikea has elaborately manipulated the image of its 83-year-old founder, now the world’s fifth-richest man, portraying him as “an ascetic, slightly dim geriatric” with alcohol problems and dyslexia, and confecting for him a typical Ikea lifestyle of modest, affordable simplicity, with a Klippan range sofa and the bog-standard Billy bookcase.

In reality, he writes, these stories were made up by Mr Kamprad (who actually drove a Porsche), then disseminated by media which fell for their quaint charm. There was good business sense to the strategy, he says: the company’s homely image “helped to push down prices with suppliers”.

A £20million, decade-long investigation overseen by the World Health Organisation (WHO) will publish evidence that heavy users face a higher risk of developing brain tumours later in life, The Daily Telegraph can disclose.

The conclusion, while not definitive, will undermine assurances from the government that the devices are safe and is expected to put ministers under pressure to issue stronger guidance.

A preliminary breakdown of the results found a “significantly increased risk” of some brain tumours “related to use of mobile phones for a period of 10 years or more” in some studies.

The head of the Interphone investigation said that the report would include a “public health message”.

Britain’s Department of Health has not updated its guidance for more than four years. It says that “the current balance of evidence does not show health problems caused by using mobile phones”, and suggests only that children be “discouraged” from making “non-essential” calls while adults should “keep calls short”.

In contrast, several other countries, notably France, have begun strengthening warnings and American politicians are urgently investigating the risks.

The Interphone inquiry has been investigating whether exposure to mobile phones is linked to three types of brain tumour and a tumour of the salivary gland.

Its head, Dr Elisabeth Cardis, backed new warnings.

“In the absence of definitive results and in the light of a number of studies which, though limited, suggest a possible effect of radiofrequency radiation, precautions are important,” she said.

“I am therefore globally in agreement with the idea of restricting the use by children, though I would not go as far as banning mobile phones as they can be a very important tool, not only in emergencies, but also maintaining contact between children and their parents and thus playing a reassurance role.

“Means to reduce our exposure (use of hands-free kits and moderating our use of phones) are also interesting.”

The project conducted studies in 13 countries, interviewing tumour sufferers and people in good health to see whether their mobile phone use differed. It questioned about 12,800 people between 2000 and 2004.

Jamie Leigh Jones (born 1984)[1] is a former KBR employee who claims that seven KBR employees drugged and gang-raped her on July 28, 2005 at Camp Hope, Baghdad, Iraq.[2][3][4] She has filed a lawsuit against the company and the employees.

She is the founder of the Jamie Leigh Foundation, an advocacy agency for victims of sexual assault.

Jones began working for KBR as an administrative assistant in 2004 when she was 19, and started her contract of employment with Overseas Administrative Services, Ltd. in Houston, Texas on July 21, 2005.

Incident

According to Jones, on July 28, 2005, several of her fellow KBR employees offered her a drink containing a date rape drug, of which she took two sips. The men then allegedly engaged in unprotected anal and vaginal gang-rape upon her while she was unconscious. She was able to name one of her attackers based on his confession to her, but was unable to identify the others due to her unconsciousness. Further, the lawsuit filed by Jones’ attorneys cites the following: “When she awoke the next morning still affected by the drug, she found her body naked and severely bruised, with lacerations to her vagina and anus, blood running down her leg, her breast implants ruptured, and her pectoral muscles torn – which would later require reconstructive surgery. Upon walking to the rest room, she passed out again.”[5] Jones’ account was confirmed by U.S. Army physician Jodi Schultz.[6] Schultz gave the rape kit she used to gather evidence from Jones to KBR/Halliburton security forces, after which the rape kit disappeared. It was recovered two years later, but missing crucial photographs and notes. [7]

Jones was confined by armed guards to a shipping container containing only a bed, under the orders of her employer, KBR. She says she was denied food, water, and medical treatment. After approximately one day, says Jones, a sympathetic guard gave her a cell phone and she called her father, Tom, who in turn contacted Representative Ted Poe (RTX) who contacted the State Department. Agents were dispatched from the U.S. Embassy in Baghdad and removed Jones from KBR custody.[citation needed]

In May 2007, a State Department diplomat recovered the rape kit from Halliburton and KBR. However, notes and photographs taken by Schultz (of Jones the morning following her rape) were missing, undermining any chances of bringing the case through the criminal courts.[8]

I’m not much for slippery slope arguments, but when we’re buried in mud at the bottom of a slope, it might be prudent to see what we slipped on. In this case, as Thom Hartmann and others have pointed out, it was a court reporter’s memo attached to an obscure 1886 Supreme Court case. The memo summarized the court’s alleged opinion that the 14th Amendment applied to corporations. Corporations were people, too.

The rape case of Jamie Leigh Jones was just a logical step forward in the long-standing Republican effort to lock Americans out of the nation’s courthouses, an effort undertaken on behalf of corporate supremacy.  A woman is gang-raped by her fellow employees at government contractor KBR. The company says her contract prohibits her from seeking justice in court.

Thirty Republican U.S. senators voted to safeguard corporations from lawsuits in rape cases. You read that right the first time. The amendment they voted against, by Sen. Al Franken, D-Minnesota, would withhold government contracts from corporations that block employees from going to court when raped or sexually assaulted on the job.

The case – and the vote – stirred a little outrage, but not enough.

The Pentagon pays an average of $400 to put a gallon of fuel into a combat vehicle or aircraft in Afghanistan.

The statistic is likely to play into the escalating debate in Congress over the cost of a war that entered its ninth year last week.

Pentagon officials have told the House Appropriations Defense Subcommittee a gallon of fuel costs the military about $400 by the time it arrives in the remote locations in Afghanistan where U.S. troops operate.

“It is a number that we were not aware of and it is worrisome,” Rep. John Murtha (D-Pa.), the chairman of the House Appropriations Defense panel, said in an interview with The Hill. “When I heard that figure from the Defense Department, we started looking into it.”

The Pentagon comptroller’s office provided the fuel statistic to the committee staff when it was asked for a breakdown of why every 1,000 troops deployed to Afghanistan costs $1 billion. The Obama administration uses this estimate in calculating the cost of sending more troops to Afghanistan.

The Obama administration is engaged in an internal debate over its future strategy in Afghanistan. Part of this debate concerns whether to increase the number of U.S. troops in that country.

The top U.S. general in Afghanistan, Stanley McChrystal, reportedly has requested that about 40,000 additional troops be sent.
Democrats in Congress are divided over whether to send more combat troops to stabilize Afghanistan in the face of waning public support for the war.

Documents have emerged which detail for the first time the potentially lethal nature of toxic waste dumped by British-based oil traders in one of west Africa’s poorest countries.

More than 30,000 people from Ivory Coast claim they were affected by the ­poisonous cocktail and are currently bringing Britain’s biggest-ever group lawsuit against the company, Trafigura.

The firm chartered the ship, Probo Koala, which transported the cargo to Ivory Coast in 2006.

An official Dutch analysis of samples of the waste carried by the Probo Koala indicate that it contained approximately 2 tonnes of hydrogen sulphide, a killer gas with a characteristic smell of rotten eggs.

The documents have been obtained by the BBC. One chemist told BBC Newsnight last night that if the same quantity and mixture of chemicals had been dumped in Trafalgar Square: “You would have people being sick for several miles around … millions of people.”

How the Guardian reported the Trafigura dumping story

The existence of a previously secret injunction against the media by oil traders Trafigura can now be revealed.

Within the past hour Trafigura’s legal firm, Carter-Ruck, has withdrawn its opposition to the Guardian reporting proceedings in parliament that revealed its existence.

Labour MP Paul Farrelly put down a question yesterday to the justice secretary, Jack Straw. It asked about the injunction obtained by “Trafigura and Carter-Ruck solicitors on 11 September 2009 on the publication of the Minton Report on the alleged dumping of toxic waste in the Ivory Coast, commissioned by Trafigura”.

The Guardian was due to appear at the High Court at 2pm to challenge Carter-Ruck’s behaviour, but the firm has dropped its claim that to report parliament would be in contempt of court.

Here is the full text of Farrelly’s question:

“To ask the Secretary of State for Justice what assessment he has made of the effectiveness of legislation to protect (a) whistleblowers and (b) press freedom following the injunctions obtained in the High Court by (i) Barclays and Freshfields solicitors on 19 March 2009 on the publication of internal Barclays reports documenting alleged tax avoidance schemes and (ii) Trafigura and Carter-Ruck solicitors on 11 September 2009 on the publication of the Minton report on the alleged dumping of toxic waste in the Ivory Coast, commissioned by Trafigura.”

Alan Rusbridger, the Guardian editor, welcomed the move. He said: “I’m very pleased that common sense has prevailed and that Carter-Ruck’s clients are now prepared to vary this draconian injunction to allow reporting of parliament. It is time that judges stopped granting ‘super-injunctions’ which are so absolute and wide-ranging that nothing about them can be reported at all.”

At Westminster earlier today urgent questions were tabled by the Liberal Democrats in an attempt to get an emergency debate about the injunction.

Bloggers were active this morning in ‘speculating’ (Bloggers came up with the correct answer, which pressed the UK censorship into allowing the Guardian to report it now.) about what lay behind the ban on the Guardian reporting parliamentary questions. Proposals being circulated online included plans for a protest outside the offices of Carter-Ruck.

Canada is protecting the drugmaker of swine flu vaccine from lawsuits over potential side effects, Canada’s top doctor has confirmed.

Dr. David Butler-Jones told a media teleconference Wednesday that Canada will shield GlaxoSmithKline, in the unlikely event (???) there are problems with the vaccine, but it will not shield health practitioners who make mistakes in administering the shot.

“We’re not obviously anticipating problems with it, but indemnification for a vaccine is important if someone does malpractice, basically injects someone the wrong way or causes harm because of their practice,” he said.

(Financial Times) Patients who fail to pop pills on time could soon benefit from having a chip on their shoulder, under a ground-breaking electronic system being developed by Novartis, the Swiss pharmaceuticals group.

The company is testing technology that inserts a tiny microchip into each pill swallowed and sends a reminder to patients by text message if they fail to follow their doctors’ prescriptions.

The partnership with Proteus Biomedical, which originally developed the technology, is one of several alliances under development by Novartis as it and rival pharmaceuticals companies attempt to maintain high prices for innovative medicines by ensuring that they are taken as the doctor ordered. Pfizer’s Health Solutions division has developed a system to telephone patients to encourage them to take medicine.

Joe Jimenez, head of pharmaceuticals at Novartis, said tests using the system – which broadcasts from the “chip in the pill” to a receiver on the shoulder – on 20 patients using Diovan, a drug to lower blood pressure, had boosted “compliance” with prescriptions from 30 per cent to 80 per cent after six months.

Sept. 2 (Bloomberg) — Pfizer Inc. agreed to a $1.2 billion criminal fine, the largest in U.S. history, and a felony plea by a subsidiary to close an investigation into what government lawyers described as fraudulent marketing of drugs.

The fine, over sales practices for a painkiller since pulled from the market, makes up the biggest single share of a record $2.3 billion settlement, announced today, between the U.S. Justice Department and New York-based Pfizer. The deal includes $1 billion in civil penalties, the largest non-criminal fraud case against a drugmaker, the department said.

Pfizer, the world’s largest drugmaker, entered into a five- year integrity agreement with the Health and Human Services Department as well. The government pays for medicines through several health programs and joined the investigation after private whistleblowers filed lawsuits in three states. The criminal case revolved around allegations that the painkiller Bextra and three other medicines were promoted for uses other than those approved by the Food and Drug Administration.

Despite its obvious benefits for our health and for the environment, organic food continues to be denigrated by the political and corporate establishment in Britain.

The food industry, in alliance with pharmaceutical and big biotechnology companies, has waged a long, often cynical campaign to convince the public that mass-produced, chemically-assisted and intensively-farmed products are just as good as organic foods, despite mounting evidence to the contrary.

The latest assault in this propaganda exercise comes from the Food Standards Agency, the government’s so-called independent watchdog, which has just published a report claiming that there is no nutritional benefit to be gained from eating organic produce.

Those forces bent on promoting GM crops and industrialised production, would have been delighted by the widespread media coverage of the Agency’s report, portraying enthusiasm for organic foods as little more than a fad among neurotic consumers that would pass once the public is given the correct information.

But what is truly misguided is not the increasing popularity of organic goods, but the Food Standards Agency’s determination to halt this trend and instead promote genetic modification.

The new report from the FSA highlights this. For all the publicity it has attracted, the document does not contain any new material.

In fact, it is just an analysis of existing research carried out by other bodies. Moreover, the organisation that conducted this second-hand study, the London School of Hygiene and Tropical Medicine, is not renowned as a leading centre in this field.

Indeed, there is far more significant work currently being done on organic foods by several other bodies, some of it funded by the European Union, though the FSA has chosen to ignore it.

It is difficult to avoid the conclusion that the FSA has decided to give such loud backing to this report because it can bend the findings to suit its political, pro-GM, anti-organic agenda.

The first chairman, Sir John Krebs (“Krebs” by the way is the German word for “Cancer”. – Infinite Unknown) , was supportive of the biotechnology lobby and only too keen to promote GM as the future of farming.

The documents also revealed Lilly officials wrote medical journal studies about Zyprexa and then asked doctors to put their names on the articles, a practice called “ghostwriting.”

Lilly employees compiled a guide to hiring scientists to write favorable articles, complained to journal editors when publication was delayed and submitted rejected articles to other outlets, according to the documents.

June 12 (Bloomberg) — Eli Lilly & Co. urged doctors to prescribe Zyprexa for elderly patients with dementia, an unapproved use for the antipsychotic, even though the drugmaker had evidence the medicine didn’t work for such patients, according to unsealed internal company documents.

In 1999, four years after Lilly sent study results to the U.S. Food and Drug Administration showing Zyprexa didn’t alleviate dementia symptoms in older patients, it began marketing the drug to those very people, according to documents unsealed in insurer suits against the company for overpayment.

Regulators required Lilly and other antipsychotic drug- makers in April 2005 to warn that the products posed an increased risk to elderly patients with dementia. The documents show the health dangers in marketing a drug for an unapproved use, called off-label promotion, said Sidney Wolfe, head of the health research group at Public Citizen in Washington.

“By definition, off-label means there is no clear evidence that the benefits of a drug outweigh the risks,” Wolfe said. “The reason why off-label promotion is illegal is that you can greatly magnify the number of people who will be harmed.”

In 1999, when Lilly began its marketing push, Zyprexa’s only approved use was for patients suffering from schizophrenia, according to the FDA. In 2008, Zyprexa was Lilly’s best-selling drug, with $4.7 billion in sales, while antipsychotics as a group topped U.S. drug sales last year, with $14.6 billion.

Seven Studies

In a request for a December 2003 meeting over a proposed label change, Lilly told the FDA that data from seven studies showed Zyprexa didn’t alleviate symptoms of Alzheimer’s or other dementia.

The studies found death rates among older dementia patients taking Zyprexa were “significantly greater” than those who didn’t get the medicine, the company said, according to the unsealed documents.
