Pentagon Says Army Pay Runs Out Unless Congress Acts

May 6 (Bloomberg) — The U.S. Army won’t be able to pay soldiers beyond June 15 unless Congress approves $108 billion more for the wars in Iraq and Afghanistan or authorizes a funds transfer, a Defense Department official said.

If the supplemental spending legislation isn’t enacted by then, the Pentagon will be forced to seek congressional authority to use money designated for other services to fund the Army payroll, department spokesman Geoff Morrell said.

Pentagon budget officials briefed congressional staffers about the funding crunch earlier today, and Defense Secretary Robert Gates addressed the issue in a letter to lawmakers yesterday, Morrell said at a Pentagon briefing.

“He is taking members, leaders, at their word that they will have this bit of business done by Memorial Day,” Morrell said. At the same time, Gates asked his budget personnel “to begin contingency planning for the possibility that the Congress does not meet its goal of passing a budget bill the president can sign” by that date.

If the measure isn’t approved, Morrell said, the accounts that fund military operations and equipment maintenance would last a little longer than the Army payroll account, “but not much more.”

EPA might not act to limit rocket fuel in drinking water

An EPA official said Tuesday there’s a “distinct possibility” the agency won’t take action to rid drinking water of a toxic rocket fuel ingredient that has contaminated public water supplies around the country.

Democratic senators called that unacceptable. They argued that states and local communities shouldn’t have to bear the expense of cleansing their drinking water of perchlorate, which has been found in at least 395 sites in 35 states – or the risk of not doing so.

The toxin interferes with thyroid function and poses developmental health risks, particularly to fetuses.

Benjamin Grumbles, assistant administrator for water at the Environmental Protection Agency, told a Senate hearing that EPA is aware that perchlorate is widespread and poses health risks.

Luminaries at the Trilateral Commission meeting in Washington expressed confidence that they own all three major presidential candidates, who, despite political posturing, will support sovereignty-surrendering measures such as NAFTA and the “North American Union.”

“John has always supported free trade, even while campaigning before union leaders,” said one. “Hil and Barack are pretending to be unhappy about some things, but that’s merely political posturing. They’re solidly in support.”

He was referring to Sens. John McCain (R-Ariz.), Hillary Clinton (D-N.Y.) and Barack Obama (D-Ill.).

Mrs. Clinton, they noted, held strategy sessions as first lady on how to get Congress to approve NAFTA “without changes.” As president, they agreed, she would do no more than “dot an i or cross a t.”

Candidate Obama has not denied news reports in Canada that his top economic adviser, Austan Goolsbee, assured Canadian diplomats that the senator would keep NAFTA intact and his anti-trade talk is just “campaign rhetoric.”

PETRIFIED ABOUT PAUL

While they are confident they can deal with any “potential president,” the Trilateralists paid huge tribute to Ron Paul in an equally large twist of irony, by expressing alarm that he is causing “significant future damage.”

They expressed concern that Paul’s rallies have attracted multitudes of young people who are getting “their political education.” They want Republicans to pressure Paul to drop out now and stop his education rallies. This assignment was given to Thomas Foley, former U.S. House speaker.

The reasons Paul’s “education campaign” strikes fear into Trilateral hearts are obvious. Paul would refuse to surrender an ounce of U.S. sovereignty to an international organization and TC wants world government.

Paul would immediately bring U.S. troops home from Iraq, Afghanistan and from 130 UN “peacekeeping” missions around the globe. TC wants to enjoy war profiteering and global power. Paul would abolish the federal income tax while the TC wants to pile on a global tax payable to the UN.

The formal agenda was loaded with everything Paul and American patriots detest: higher taxes, more foreign giveaways, more immigration, both legal and illegal, into the United States and “engaging Iran,” among others.

Your personal data just got permanently cached at the US border

Now that US customs agents have unfettered access to laptops and other electronic devices at borders, a coalition of travel groups, civil liberties advocates and technologists is calling on Congress to rein in the Department of Homeland Security’s search and seizure practices. They’re also providing practical advice on how to prevent trade secrets and other sensitive data from being breached.

In a letter dated Thursday, the group, which includes the Electronic Frontier Foundation (EFF), the American Civil Liberties Union and the Business Travel Coalition, called on the House Committee on Homeland Security to ensure searches aren’t arbitrary or overly invasive. They also urged the passage of legislation outlawing abusive searches.

The letter comes 10 days after a US appeals court ruled Customs and Border Protection (CBP) agents have the right to rummage through electronic devices even if they have no reason to suspect the hardware holds illegal contents. Not only are they free to view the files during passage; they are also permitted to copy the entire contents of a device. There are no stated policies about what can and can’t be done with the data.

Over the past few months, several news reports have raised eyebrows after detailing border searches that involved electronic devices. The best known of them is this story from The Washington Post, which recounted the experiences of individuals who were forced to reveal data on cell phones and laptop devices when passing through US borders. One individual even reported some of the call history on her cell phone had been deleted.

“The Fourth Amendment protects us all against unreasonable government intrusions,” the letter, which was also signed by the Center for Democracy and Technology and security expert Bruce Schneier, states. “But this guarantee means nothing if CBP can arbitrarily search and seize our digital information at the border and indefinitely store and reuse it.”

Several of the groups are also providing advice to US-bound travelers carrying electronic devices. The Association of Corporate Travel Executives is encouraging members to remove photos, financial information and other personal data before leaving home. This is good advice even if you’re not traveling to the US. There is no reason to store five years worth of email on a portable machine.

In this posting, the EFF agrees that laptops, cell phones, digital cameras and other gizmos should be cleaned of any sensitive information. Then, after passing through customs, travelers can download the data they need, work on it, transmit it back and then digitally destroy the files before returning.

The post also urges the use of strong encryption to scramble sensitive data, although it warns this approach is by no means perfect. For one thing, CBP agents are free to deny entry to travelers who refuse to divulge their passwords. They may also be able to seize the laptop.

If it sounds like a lot of work, consider this: so far, the federal government has refused to reveal any information about border searches, including what it does with the electronic data it seizes. Under the circumstances, there’s no way of knowing what will happen to, say, source code or company memos that may get confiscated. Or the email sent to your lawyer.

May 2 (Bloomberg) — A month after the Federal Reserve rescued Bear Stearns Cos. from bankruptcy, Chairman Ben S. Bernanke got an S.O.S. from Congress.

There is “a potential crisis in the student-loan market” requiring “similar bold action,” Chairman Christopher Dodd of Connecticut and six other Democrats wrote Bernanke. They want the Fed to swap Treasury notes for bonds backed by student loans. In a separate letter, Pennsylvania Democratic Representative Paul Kanjorski and 31 House members said they want Bernanke to channel money directly to education-finance firms.

Student loans are just the start. Former Fed officials and other Fed-watchers say that Bernanke’s actions in saving Bear Stearns will expose the central bank to continuing pressure to use its $889 billion balance sheet to prop up companies or entire industries deemed important by politicians. The Fed satisfied Dodd’s request today, expanding the swaps to include securities backed by student debt.

“It is appalling where we are right now,” former St. Louis Fed President William Poole, who retired in March, said in an interview. The Fed has introduced “a backstop for the entire financial system.”

Critics argue that the result will be to foster greater risk-taking among investors emboldened by the belief that the government will bail them out of bad decisions.

The Fed’s loans to Bear Stearns were “a rogue operation,” said Anna Schwartz, who co-wrote “A Monetary History of the United States” with the late Nobel laureate Milton Friedman.

`No Business’

“To me, it is an open and shut case,” she said in an interview from her office in New York. “The Fed had no business intervening there.”

Senator: VA lying about number of veteran suicides

WASHINGTON — The Veterans Administration has lied about the number of veterans who’ve attempted suicide, a senator charged Wednesday, citing internal e-mails that put the number at 12,000 a year when the department was publicly saying it was fewer than 800.

“The suicide rate is a red-alarm bell to all of us,” said Sen. Patty Murray, D-Wash. Murray also said that the VA’s mental health programs are being overwhelmed by Iraq and Afghanistan war veterans, even as the department tries to downplay the situation.

“We are not your enemy, we are your support team, and unless we get accurate information we can’t be there to do our jobs,” Murray told Deputy Secretary of Veterans Affairs Gordon Mansfield during the Senate Veterans Affairs Committee hearing.

FBI wants widespread monitoring of illegal Internet activity

WASHINGTON–The FBI on Wednesday called for new legislation that would allow federal police to monitor the Internet for “illegal activity.”

The suggestion from FBI Director Robert Mueller, which came during a House of Representatives Judiciary Committee hearing, appears to go beyond a current plan to monitor traffic on federal-government networks. Mueller seemed to suggest that the bureau should have a broad “omnibus” authority to conduct monitoring and surveillance of private-sector networks as well.

The surveillance should include all Internet traffic, Mueller said, “whether it be .mil, .gov, .com–whichever network you’re talking about.” (See the transcript of the hearing.)

Environment head not liable for 9/11 assurances

NEW YORK (Reuters) – The former head of the U.S. Environmental Protection Agency cannot be held liable for assurances she gave about air safety following the September 11 attacks in New York, a federal appeals court ruled on Tuesday.

Christine Todd Whitman led the agency at the time of the attacks and was sued by people who lived and worked in lower Manhattan who accused her of statements that “falsely represented … that the air in and around lower Manhattan was safe to breathe.”

The U.S. Court of Appeals for the Second Circuit found that Whitman was faced with conflicting information about dangers posed by the dust and that she had passed on assurances that came from the White House.

While the judges understood the concern that the agency’s performance was “flawed,” they said that “legal remedies are not always available for every instance of arguably deficient governmental performance.”

The court also noted that Congress has set aside a process to compensate victims of the attacks.

“A bare allegation that the head of a government agency, guided by a relevant White House office, knew that her statements were false and ‘knowingly’ issued false press releases is not plausible in the absence of some supporting facts,” the decision said.

Rescue workers and others who spent time near the disaster site have reported a variety of respiratory ailments that they believe came from breathing the ash and dust caused by the collapse of the Twin Towers.

Justice Dept. Details Program for Collecting DNA From People in Federal Custody

The Bush administration moved forward on Friday with a program to expand collecting DNA samples from people in federal custody.

But it was unclear how federal laboratories would be able to handle the added work.

The Justice Department formally proposed regulations for collecting the samples, a technique that essentially mirrors taking the fingerprints of people arrested for federal offenses, as well as illegal immigrants detained by federal authorities.

The government now collects DNA just from felons. DNA, the genetic marker found in hair and blood and other body fluids, can provide a more concrete link to a crime than fingerprints, which often are not left at a crime scene or are difficult to collect.

For the new effort to succeed, the samples, most collected by swabbing an inside cheek, have to be entered into the DNA database of the F.B.I.

A spokeswoman for the bureau’s laboratory, Ann Todd, said it already had a backlog of 225,000 samples to be processed, a more complex procedure than entering fingerprints.

If Justice Department estimates are accurate, work at the laboratory would increase twelvefold, Ms. Todd said.

Pentagon seeks authority over training foreign militaries

Representative Duncan Hunter, the ranking Republican on the House Armed Services Committee, suggested that the military was being saddled with additional responsibilities because the State Department has been sluggish in responding to new needs. Hunter said “the need to train and equip foreign forces and to provide stabilization programs will remain necessary as we continue to fight the global war on terror.”

The Pentagon asked Congress Tuesday to give it permanent authority over training and equipping foreign militaries, in a shifting of roles from the State Department.

Both Defense Secretary Robert Gates and Secretary of State Condoleezza Rice sought Congressional approval for the change, as well as authorization for the Pentagon to spend 750 million dollars in 2009 in helping foreign militaries.

Gates told members of the House Armed Services Committee the foreign military assistance program is “a vital and enduring military requirement, irrespective of the capacity of other departments, and its authorities and funding mechanisms should reflect that reality.”

Some lawmakers said it raised questions about the military’s growing role in domains traditionally reserved for diplomats.

Administration Set to Use New Spy Program in U.S.

The Bush administration said yesterday that it plans to start using the nation’s most advanced spy technology for domestic purposes soon, rebuffing challenges by House Democrats over the idea’s legal authority.

Homeland Security Secretary Michael Chertoff said his department will activate his department’s new domestic satellite surveillance office in stages, starting as soon as possible with traditional scientific and homeland security activities — such as tracking hurricane damage, monitoring climate change and creating terrain maps.

Sophisticated overhead sensor data will be used for law enforcement once privacy and civil rights concerns are resolved, he said. The department has previously said the program will not intercept communications.

Slamming the final nail in the coffin of everything America used to stand for, the boot-licking U.S. Senate last night gave President Bush the legal authority to abduct and sexually mutilate American citizens and American children in the name of the war on terror.

There is nothing in the “detainee” legislation that protects American citizens from being kidnapped by their own government and tortured.

Yale Law Professor Bruce Ackerman states in the L.A. Times, “The compromise legislation….authorizes the president to seize American citizens as enemy combatants, even if they have never left the United States. And once thrown into military prison, they cannot expect a trial by their peers or any other of the normal protections of the Bill of Rights.”

Similarly, law Professor Marty Lederman explains: “this [subsection (ii) of the definition of ‘unlawful enemy combatant’] means that if the Pentagon says you’re an unlawful enemy combatant — using whatever criteria they wish — then as far as Congress, and U.S. law, is concerned, you are one, whether or not you have had any connection to ‘hostilities’ at all.”

We have established that the bill allows the President to define American citizens as enemy combatants. Now let’s take it one step further.

Before this article is dismissed as another extremist hyperbolic rant, please take a few minutes out of your day to check for yourself the claim that Bush now has not only the legal authority but the active blessings of his own advisors to torture American children.

The backdrop of the Bush administration’s push to obliterate the Geneva Conventions was encapsulated by John “torture” Yoo, professor of law at Berkeley, co-author of the PATRIOT Act, author of torture memos and White House advisor.

During a December 1st debate in Chicago with Notre Dame professor and international human rights scholar Doug Cassel, John Yoo gave the green light for the scope of torture to legally include sexual torture of infants.

Cassel: If the president deems that he’s got to torture somebody, including by crushing the testicles of the person’s child, there is no law that can stop him?

Yoo: No treaty.

Cassel: Also no law by Congress — that is what you wrote in the August 2002 memo…

Yoo: I think it depends on why the President thinks he needs to do that.

Haitian President Fails to Restore Order

PORT-AU-PRINCE, Haiti – A desperate appeal from the president Wednesday failed to restore order to Haiti’s shattered capital, and bands of looters sacked stores, warehouses and government offices.

Gunfire rang out from the wealthy suburbs in the hills to the starving slums below as 9,000 U.N. peacekeepers were unable to halt a frenzy of looting and violence that has grown out of protests over rising food prices.

Many of the protesters are demanding the resignation of the U.S.-backed president, Rene Preval, and on Tuesday U.N. peacekeepers had to fire rubber bullets and tear gas to drive away a mob that tried to storm his palace.

He delivered his first public comments Wednesday, nearly a week into the protests. With his job on the line, Preval urged Congress to cut taxes on imported food and appealed to the rioters to go home.

“The solution is not to go around destroying stores,” he said. “I’m giving you orders to stop.”

But gunfire rang out around the palace after the speech, as peacekeepers tried to drive away people looting surrounding stores.

The streets remained in the control of bands of young men carrying sticks and rocks, who set up roadblocks of burning tires and stopped passing cars. Businesses were closed and most people locked themselves indoors, as mobs looted stores, warehouses and government offices.

The neocon lacky Petraeus has had his script written for him by Cheney, and Petraeus together with neocon warmonger Ryan Crocker, the US governor of the Green Zone in Baghdad, will present Congress next Tuesday and Wednesday with the lies, for which the road has been well paved by neocon propagandists such as Kimberly Kagan, that “the US must recognize that Iran is engaged in a full-up proxy war against it in Iraq.”

Don’t expect Congress to do anything except to egg on the attack. On April 3 the International Herald Tribune reported that senators and representatives have made millions of dollars from their investments in defense companies totaling $196 million. Rep. Ike Skelton, the Democrat chairman of the House Armed Services Committee, is already on board with the attack on Iran. The London Telegraph quotes Skelton: “Iran is the bull in the china shop. In all of this, they seem to have links to all of the Shi’ite groups, whether they be political or military.”

Secret plans for US troops to stay in Iraq

A secret draft agreement is being drawn up to allow United States forces to remain in Iraq indefinitely, it has been reported.

    • The document, which was written a month ago and is and marked “secret” and “sensitive”, is intended to replace the United Nations mandate for coalition troops, including British forces, to remain in Iraq, which expires at the end of the year.

    The draft authorisation would allow for the US to “conduct military operations in Iraq and to detain individuals when necessary for imperative reasons of security”.

    It does not set a time limit, but describes the arrangement as temporary and points out that the US does not want “permanent bases or a permanent military presence” in the country. It also states that the US does not seek to use Iraq as a base to launch operations against other states.

    The draft agreement is unlikely to emerge unscathed from political scrutiny in Baghdad or Washington. There appears little appetite in the US for a drawn-out occupation of Iraq. In Baghdad, both Shia and Sunni political groups opposed to the American presence are likely to oppose the agreement in its draft form.

    Moqtada al-Sadr, a vocal critic of the occupation, said yesterday that he would consider disbanding his powerful Mahdi army – but only after consulting the ayatollahs, or religious leaders.

    Iraq’s prime minister, Nouri al-Maliki, said that if the militia, which has battled American and government forces in Basra and Baghdad for the past two weeks, was not disbanded its political wing would be barred from provincial elections.

    “They no longer have a right to participate in the political process or take part in the upcoming elections unless they end the Mahdi army,” said Mr Maliki.

    Sadr said he would consult religious figures, including Grand Ayatollah Ali al-Sistani, the moderate Shia leader who is revered as a “source of emulation”.

    By putting the fate of his powerful militia in the hands of the religious hierarchy, the cleric appears to be gambling that he will establish his credentials as a figure capable of unifying Iraq’s majority Shia community under his leadership.

    However, Sadr said ayatollahs in the Iranian city of Qom, home to his spiritual mentor Grand Ayatollah Kazim al-Haeri, a known hard-liner, would also have a say.

    The cleric’s supporters will tomorrow attempt to mount a “million-strong” march in Baghdad to mark the fifth anniversary of the city’s fall. It will follow a report on Iraq to the US Congress in Washington by General David Petraeus and Ryan Crocker, the ambassador to Baghdad.

    Ritter says White House preparing for war in Iran

    MIDDLEBURY – Scott Ritter, former head of weapons inspection in Iraq who protested there were no weapons of mass destruction to justify an invasion, believes the same is true for Iran.

    But there is an 80 percent chance of war with Iran, he told about 200 people Wednesday at Middlebury College as part of a series of talks facilitated by the Vermont Peace and Justice Center.

    The pattern of preparations for such a conflict has been steadily developing and involves Congress as well as the Bush-Cheney administration, he said.

    Homeland Ministry Plans Raytheon “Ray Guns” at Airports

    The DHS, affectionately called the “Ministry” here because it resembles something out of Orwell’s famous novel, wants to fit airports with ray guns. I kid you not. “The US Department of Homeland Security (DHS) will consider fitting high-power microwave electropulse rayguns at US airports, in order to defend against the threat of terrorists firing portable anti-aircraft missiles at airliners,” reports Lewis Page for The Register. “American defense heavyweight Raytheon would partner with Israel’s Rafael and Kongsberg of Norway to provide the technology, according to a report in Flight International. The proposed kit is known as ‘Vigilant Eagle’, and is competing for DHS securo-dollars with defensive systems that could be fitted to the airliners themselves – for instance BAE Systems’ JetEye.”

    Okay, tell me this does not sound like another “defense industry” scam, yet another scheme to make billions of dollars. Sure, there is the possibility somebody with a rocket launcher may take out an airliner. But if al-Qaeda hates our freedom, why haven’t’ they done this already? Is al-Qaeda conducting a war against the Great Satan, one with battles strung over decades? At this rate, it will take a thousand years to install the Great Caliph/Khalifah.

    Bernanke Warns of Possible Recession

    WASHINGTON (AP) – Federal Reserve Chairman Ben Bernanke said Wednesday a recession is possible and policymakers are “fighting against the wind” in trying to steady a shaky economy. He would not say if further interest rate cuts are planned.

    Bernanke’s testimony before the Joint Economic Committee of Congress was a more pessimistic assessment of the economy’s immediate prospects than a report he delivered earlier this year. His appearance on Capitol Hill came amid a trio of economic slumps in the housing, credit and financial areas.

    “It now appears likely that gross domestic product (GDP) will not grow much, if at all, over the first half of 2008 and could even contract slightly,” Bernanke told lawmakers. GDP measures the value of all goods and services produced within the United States and is the best barometer of the United States’ economic health. Under one rule, six straight months of declining GDP, would constitute a recession.

    Al Gore yesterday launched a drive to mobilise 10 million volunteers to force politicians to act on climate change – twice as many as the number who marched against the Vietnam war or in support of civil rights during the heyday of US activism in the 1960s.

    During the next three years, his Alliance for Climate Protection plans to spend $300m (about £150m) on television advertising and online organising to make global warming among the most urgent issues for elected American leaders.

    The wecansolveit.org initiative aims to build up pressure on the next US president to support stringent mandatory emissions controls when they come before Congress, and take a leadership role at the renegotiation of the Kyoto treaty.
