Fast and Furious weapons were found in Mexico cartel enforcer’s home (Los Angeles Times, October 8, 2011):

Reporting from Washington — High-powered assault weapons illegally purchased under the ATF’s Fast and Furious program in Phoenix ended up in a home belonging to the purported top Sinaloa cartel enforcer in Ciudad Juarez, Mexico, whose organization was terrorizing that city with the worst violence in the Mexican drug wars.

In all, 100 assault weapons acquired under Fast and Furious were transported 350 miles from Phoenix to El Paso, making that West Texas city a central hub for gun traffickers. Forty of the weapons made it across the border and into the arsenal of Jose Antonio Torres Marrufo, a feared cartel leader in Ciudad Juarez, according to federal court records and trace documents from the Bureau of Alcohol, Tobacco, Firearms and Explosives.

The smugglers’ tactics — quickly moving the weapons far from ATF agents in southern Arizona, where it had been assumed they would circulate — vividly demonstrate that what had been viewed as a local problem was much larger. Six other Fast and Furious guns destined for El Paso were recovered in Columbus, N.M.

“These Fast and Furious guns were going to Sinaloans, and they are killing everyone down there,” said one knowledgeable U.S. government source, who asked for anonymity because of the ongoing investigations. “But that’s only how many we know came through Texas. Hundreds more had to get through.”

WASHINGTON — The federal government under the Bush administration ran an operation that allowed hundreds of guns to be transferred to suspected arms traffickers — the same tactic that congressional Republicans have criticized President Barack Obama’s administration for using, two federal law enforcement officials said Tuesday.

Rep. Darrell Issa, R-Calif., Sen. Chuck Grassley, R-Iowa, and other Republicans have been hammering the Obama Justice Department over the practice known as “letting guns walk.” The congressional target has been Operation Fast and Furious, which was designed to track small-time gun buyers at several Phoenix-area gun shops up the chain to make cases against major weapons traffickers. In the process, federal agents lost track of many of the more than 2,000 guns linked to the operation.

When Bush, a Republican, was president, the Bureau of Alcohol, Tobacco, Firearms and Explosives in Tucson, Ariz., used a similar enforcement tactic in a program it called Operation Wide Receiver. The fact that there were two such ATF investigations years apart in separate administrations raises the possibility that agents in still other cases may have allowed guns to “walk.”

For months, Issa and other Republicans have focused on whether Attorney General Eric Holder misled Congress, suggesting that he knew more than he has admitted about Operation Fast and Furious.

New Fast and Furious docs released by White House (CBS News, Sep. 30, 2011):

WASHINGTON – Late Friday, the White House turned over new documents in the Congressional investigation into the ATF “Fast and Furious” gunwalking scandal.

The documents show extensive communications between then-ATF Special Agent in Charge of the Phoenix office Bill Newell – who led Fast and Furious – and then-White House National Security Staffer Kevin O’Reilly. Emails indicate the two also spoke on the phone. Such detailed, direct communications between a local ATF manager in Phoenix and a White House national security staffer has raised interest among Congressional investigators looking into Fast and Furious. Newell has said he and O’Reilly are long time friends.

ATF agents say that in Fast and Furious, their agency allowed thousands of assault rifles and other weapons to be sold to suspected traffickers for Mexican drug cartels. At least two of the guns turned up at the murder scene of Border Patrol Agent Brian Terry last December.

The Favored Few Get New Positions

Obviously perplexed with what to do with Melson, the U.S. Justice Department moved Melson to a new post inside the ATF, a position that protects his retirement package. Perhaps this is some of the “appropriate action” President Obama said would be taken, if so, more appropriate action soon followed.

The Obama administration next promoted some of the officials who ran the program. William G. McMahon, who was the ATF’s deputy director of operations in the West, William D. Newell, and David Voth, who were both field supervisors who oversaw the Fast and Furious program out of the agency’s Phoenix office, were promoted to positions in Washington, D.C. Voth is the one who said in an email, “If you don’t think [Fast and Furious] is fun you’re in the wrong line of work — period.” And, when asked if guns were being allowed to cross the southern border, Newell is the one who said, “Hell, no.” Yet both got cushy desk jobs in D.C.

Then, as if to shine a spotlight on how political the Fast and Furious operation always was, last August the Obama administration announced new firearm-reporting regulations that gun stores in southern border states must follow—this when gun storeowners have done everything asked of them and as the National Shooting Sports Foundation (NSSF), the trade association that represents firearms manufacturers, pays for a longstanding program called “Don’t Lie for the Other Guy” (www.dontlie.org ) that combats illegal gun sales by raising awareness.

Also, the National Rifle Association has been on top of this story from the beginning. Chris W. Cox, the NRA’s chief lobbyist now says, “It would be a serious miscarriage of justice if no one is held accountable for this deadly scandal. The President and his Justice Department cannot run away from this. The NRA will make sure that every member, hunter, gun owner, and indeed every American, knows the truth about this reckless operation.”

Given all the politics and the cover up that even the former ATF director says has occurred, could operation Fast and Furious have been about anything other than pushing for new gun-control laws? And given all of this obfuscation from the Obama administration, isn’t this scandal comparable to the cover up that surrounded Watergate? After all, both administrations forgot that America is a country that reveres its freedom of the press and that in America officers speak out when misguided policies get cops killed. Here mothers testify before Congress when they find out a secret government program, and a stupid one at that, got their son killed.

Not that morality ends at the American border. To stress this point, Rep. Issa held a conference call with journalists on September 21 in which he said Marisela Morales, Mexico’s attorney general, is reporting that at least 200 Mexican deaths can now be traced to weapons from the Fast and Furious program.

And so the investigation and the bloody aftermath continue….

ATF Gunwalker: Who at the White House knew? (CBS News, September 2, 2011):

CBS News has obtained a series of emails that show the White House had more information on ATF’s controversial Fast and Furious operation than previously disclosed. But administration officials insists nobody at the White House knew specifically that ATF was allowing guns to “walk” into the hands of suspected gun traffickers for Mexican drug cartels.

ATF ‘allegedly’ allowed more than two thousand assault rifles and other weapons to fall into the hands of suspects from late fall of 2009 through 2010.

The emails indicate three White House officials were briefed on gun trafficking efforts that included Fast and Furious. The officials are Kevin O’Reilly, then-director of North American Affairs, now assigned to the State Department; Dan Restrepo, senior Latin American advisory; and Greg Gatjanis, a national security official.

The White House officials were provided information on Fast and Furious and other border gun trafficking efforts through what an administration source calls “back channels” by ATF’s then-Special Agent in Charge of Phoenix Bill Newell. “…don’t want ATF HQ to find out, especially since this is what they should be doing (briefing you),” Newell wrote in an email to the White House’s O’Reilly on July 28, 2010. Newell has since been transferred out of that post.

A police officer killed while responding to a domestic disturbance in a small eastern Pennsylvania borough had pointed a stun gun at two dogs before being shot, court records reveal.

Freemansburg police officer Robert Lasso had pointed at the attacking dogs when the homeowner pulled out a shotgun and fired the fatal blast on Thursday evening.

In police custody, the alleged gunman, 46-year-old George Hitcho Jr, said he had told Mr Lasso to get off his property and not come on unless he had a warrant, authorities said.

‘He tried to kill my dogs and pointed a gun in my face,’ Hitcho said, according to the documents. ‘I do not care if you a cop or not …Unbelievable.’

The officer had been responding to a report of a disturbance and ended up at the back of Hitcho’s house, authorities said.

Police Chief George Bruneio, who arrived after Mr Lasso requested assistance, instructed him to ‘shoot the dogs’ and that’s when the homeowner pulled out a shotgun and fired, authorities said.

Second Video Emerges Of Hot-Tempered Canton Police Officer (Pixiq, July 29, 2011):

A second dash cam video has emerged showing Canton police officer Daniel Harless overreacting to finding a gun in a man’s car.

The video is from July 29, 2010, exactly one year ago today.

Like the video that emerged earlier this month (second half of story), Harless can be heard threatening to kill the driver because of the gun that was found.

Unlike the last video, it is not clear whether the driver had a concealed weapons permit.

But the one thing that is clear is that Harless has a very hot temper and does nothing to deescalate a potential violent situation.

Here is just a small sample of what Harless told the man he pulled over.

“Do not move a muscle or I will put you in the grave.”

“I’ll shoot you in the face and I’ll go to sleep tonight.”

The first video to emerge has prompted gun advocate groups to call for Harless’ resignation.

Canton residents also created a Facebook page demanding his removal.

CANTON, Ohio -— An arrogant police officer angrily confronts a motorist, William Bartlett, for legally carrying a hidden gun. Bartlett has a permit to carry the concealed weapon and said that he tried to tell the cop that he had a gun when he was pulled over on in the early morning hours of June 8, 2011 in a high crime area. But the 52-year-old Brewster man said that the officer “would not let [me] talk. Would you have yelled ‘I have a gun?’. I just kept my mouth shut, I kept my hands on the wheel like I had been instructed to, I had my CCW in hand, I tried to hand it to him and he wanted no part of it.” Bartlett said that Patrolman Daniel Harless flew into a rage a short time later when he revealed he was carrying a gun. He said that Harless then began to threaten his life. “If you had a man threatening to execute you, what would you think? That’s where I’ll leave it at that,” said Bartlett. Patrolman Harless has been placed on administrative leave due to the incident. William Bartlett was charged with carrying a concealed weapon, which is odd because he has a license to carry one.

CANTON, Ohio — Video of a Canton police officer angrily confronting a motorist legally carrying a concealed weapon has gone viral on the internet.
The target of that confrontation, William Bartlett, told Fox 8 on Tuesday that his rights were violated.

Bartlett has a permit to carry a concealed weapon and said he tried to tell the officer that he had a gun when he was pulled over on in the early morning hours of June 8th in a high crime area.

Guns from U.S. sting found at Mexican crime scenes (Reuters, July 26, 2011):

At least 122 firearms from a botched U.S. undercover operation have been found at crime scenes in Mexico or intercepted en route to drug cartels there, a Republican congressional report issued on Tuesday said.

Mexican authorities found AK-47 assault rifles, powerful .50 caliber rifles and other weapons as early as November 2009 that were later linked to the U.S. sting operation to trace weapons crossing the border to Mexico, the report said.

Guns from the program, dubbed “Operation Fast and Furious,” were also found at the scene of the murder of a U.S. Border Patrol agent in the border state of Arizona last December. It is unclear if they were the weapons responsible for his death.

U.S. authorities set up the undercover operation in 2009 to try to track guns bought in Phoenix on behalf of Mexican drug cartels, but many of the weapons were never traced after they left the hands of the initial buyer.

(NaturalNews) It is now a widely-reported fact that under the Obama administration, U.S. federal agents actively placed over 30,000 fully-functional weapons into the hands of Mexican drug gangs, then halted all surveillance and tracking activities of where those weapons were going.

This is not a conspiracy theory, nor a piece of fiction. It is now an openly-admitted fact that this was pulled off by the BATFE (Bureau of Alcohol, Tobacco, Firearms and Explosives, more commonly called “ATF”) under orders from Washington. The program was called “Fast and Furious.”

The engineering of the illegal gun running went right up the chain of command to the director of the ATF, Kenneth Melson, who is now expected to resign. Among the firearms sold to the Mexican drug gangs were AK-47s, thousands of pistols and, remarkably, .50-caliber rifles which are typically used to disable vehicles or carry out sniper-based assassinations at extremely long ranges (up to two miles). The mainstream media is now reporting that these weapons are turning up in violent crimes being committed in Phoenix, Arizona. As an ABC news affiliate reports:

“According to the testimony of three Phoenix ATF agents, including Dodson, hundreds of weapons are now on the streets in the United States and Mexico, possibly in the hands of criminals. Dodson estimated the number could be as many as 1,800 weapons. He estimated agents in the Phoenix field division facilitated the sale of approximately 2,500 weapons to straw purchasers. That’s why Jaquez tells CBS News he was so alarmed to hear his own agency may have done the opposite: encouraged U.S. gun dealers to sell to suspected traffickers for Mexico’s drug cartels. Apparently, ATF hoped that letting weapons “walk” onto the street – to see where they’d end up – would help them take down a cartel.

Jaquez is so opposed to the strategy, he’s speaking out. “You don’t let guns walk. I’ve never let a gun walk.”

Yet ATF agents told us they were ordered to let thousands of weapons walk. Two of them, assault rifles, were later found at the murder scene of Border Patrol Agent Brian Terry in Arizona last December. Another gunrunning suspect under ATF surveillance was linked to the shooting of Customs Agent Jaime Zapata. And sources say many more “walked” weapons turned up at Mexican crime scenes.

Jaquez said, “I think this incidence is probably one of the darkest days in ATF’s history.”

But ATF wasn’t working alone on the case known as “Fast and Furious.” Documents show ATF had conference calls with “DHS” (Homeland Security). “USMS” (U.S. Marshals) and DEA. An “ICE,” or Customs agent, was on ATF’s Fast and Furious team. They were advised by an “AUSA,” or Assistant U.S. Attorney under the Justice Department.

Swiss voters have rejected a proposal to tighten the country’s relaxed gun laws.

With final official results yet to be released, a majority in at least 18 of Switzerland’s 26 cantons voted against the proposal to ban army rifles from homes and impose new requirements for buying other guns.

The proposal would have ended the Swiss tradition of men keeping their army rifles at home – even after completing their military service. Supporters of the reform argued this would have reduced incidents of domestic violence and Switzerland’s high rate of firearms suicide.

“This is an important sign of confidence in our soldiers,” said Pius Segmueller, a lawmaker with the Christian People’s party and former commander of the Vatican’s Swiss Guard.

The government had argued that existing laws were sufficient to ensure some 2.3m weapons in a country of fewer than 8 million people are not misused.

Opposition against the proposal was strongest in rural and German-speaking parts of the country, which tend to be more conservative and where shooting clubs are popular.

French-speaking cantons in western Switzerland backed the plan, but women and young people – who according to opinion polls favour more restrictive gun laws – failed to turn out in sufficient numbers.

According to in-house memos now circulating, the DHS has issued orders to banks across America which announce to them that “under the Patriot Act” the DHS has the absolute right to seize, without any warrant whatsoever, any and all customer bank accounts, to make “periodic and unannounced” visits to any bank to open and inspect the contents of “selected safe deposit boxes.”

Further, the DHS “shall, at the discretion of the agent supervising the search, remove, photograph or seize as evidence” any of the following items “bar gold, gold coins, firearms of any kind unless manufactured prior to 1878, documents such as passports or foreign bank account records, pornography or any material that, in the opinion of the agent, shall be deemed of to be of a contraband nature.”

DHS memos also state that banks are informed that any bank employee, on any level, that releases “improper” “classified DHS Security information” to any member of the public, to include the customers whose boxes have been clandestinely opened and inspected and “any other party, to include members of the media” and further “that the posting of any such information on the internet will be grounds for the immediate termination of the said employee or employees and their prosecution under the Patriot Act.” Safety deposit box holders and depositors are not given advanced notice when failed banks shut their doors.

If people have their emergency money in a safe deposit box or an account in a bank that closes, they will not be allowed into the bank to get it out. They can knock on the door and beg to get in but the sheriff’s department or whoever is handling the closure will simply say “no” because they are just following orders.

Deposit box and account holders are not warned of the hazards of banking when they sign up. It is not until they need to get their cash or valuables out in a hurry that they find themselves in trouble.

Florida Dealership Offers Free AK-47 For Truck Buyers, Business Has More Than Doubled

SANFORD, Fla. – A central Florida dealership trying to drum up business is offering an unusual perk for potential used-truck buyers: A free AK-47 assault rifle.

General sales manager Nick Ginetta says that since the promotion was announced on Veterans Day, business has more than doubled at Nations Trucks in Sanford.

Customers would have to pass a background check before using the $400 gun shop voucher. They also have the option of using the money toward other firearms, or they can request a check in that amount instead.

Change: Obama Administration Forbids Sale of 850,000 Antique Rifles

The South Korean government, in an effort to raise money for its military, wants to sell nearly a million antique M1 rifles that were used by U.S. soldiers in the Korean War to gun collectors in America.

The Obama administration approved the sale of the American-made rifles last year. But it reversed course and banned the sale in March – a decision that went largely unnoticed at the time but that is now sparking opposition from gun rights advocates.

A State Department spokesman said the administration’s decision was based on concerns that the guns could fall into the wrong hands.

“The transfer of such a large number of weapons — 87,310 M1 Garands and 770,160 M1 Carbines — could potentially be exploited by individuals seeking firearms for illicit purposes,” the spokesman told FoxNews.com.

“We are working closely with our Korean allies and the U.S. Army in exploring alternative options to dispose of these firearms.”

Gun control advocates praised the Obama administration for taking security seriously.

“Guns that can take high-capacity magazines are a threat to public safety,” said Dennis Henigan of the Brady Campaign to Prevent Gun Violence. “Even though they are old, these guns could deliver a great amount of firepower. So I think the Obama administration’s concerns are well-taken.”

But gun rights advocates point out that possessing M1 rifles is legal in the United States — M1s are semi-automatics, not machine guns, meaning the trigger has to be pulled every time a shot is fired — and anyone who would buy a gun from South Korea would have to go through the standard background check.

WASHINGTON—The Supreme Court ruled for the first time that gun possession is fundamental to American freedom, giving federal judges the power to strike down state and local weapons laws for violating the Second Amendment.

In a 5-4 ruling, the court held that the Second Amendment’s right to keep and bear arms is a fundamental right that binds states.

“Self defense is a basic right, recognized by many legal systems from ancient times to the present day,” wrote Justice Samuel Alito. He was joined in reaching the result by Chief Justice John Roberts and justices Anthony Kennedy, Antonin Scalia and Clarence Thomas.

In 2008, the Supreme Court struck down a handgun ban in the District of Columbia, a federal enclave. Justice Alito’s opinion said that ruling “unmistakably” required the court likewise to overturn laws in Chicago and its suburb of Oak Park, Ill., that limited handgun possession.

Ashtabula County: Judge Tells Residents To ‘Arm Themselves’

JEFFERSON — In the ongoing financial crisis in Ashtabula County, the Sheriff’s Department has been cut from 112 to 49 deputies. With deputies assigned to transport prisoners, serve warrants and other duties, only one patrol car is assigned to patrol the entire county of 720 square miles.

“I did the best with what they (the county commissioners) gave me. If it wasn’t enough, don’t blame me, don’t blame this department,” said Sheriff Billy Johnson.

Johnson said he is suing the commissioners to get a determination of whether he should use his limited budget to carry out obligations defined by law or put more patrol cars on the streets.

“I just can’t do it anymore,” he said. “I have to have the court explain to the commissioners and to me what my statutory duties are.”

The Ashtabula County Jail has confined as many as 140 prisoners. It now houses only 30 because of reductions in the staff of corrections officers.

All told, 700 accused criminals are on a waiting list to serve time in the jail.

Are there dangerous people free among the 700 who cannot be locked up?

“There probably are,” Sheriff Johnson said, “but I’m telling you, any known violent criminal, we’re housing them. We’ve got murderers in there.”

Ashtabula County is the largest county in Ohio by land area.

Ashtabula County Common Pleas Judge Alfred Mackey was asked what residents should do to protect themselves and their families with the severe cutback in law enforcement.

“Arm themselves,” the judge said. “Be very careful, be vigilant, get in touch with your neighbors, because we’re going to have to look after each other.”

Assuming each gun buyer bought 1000 rounds of ammo for each purchase, and you and I know that it is way, way more than that, that would be easily 14,033,824,000+ billions rounds of ammo fired by USA gun owners.

US Supreme Court justices signal they’re ready to make gun ownership a national right

A high court majority reviewing a handgun ban in Chicago indicates that it sees the right to bear arms as national in scope, and can be used to strike down some state and local gun regulations.

Reporting from Washington – The Supreme Court justices, hearing a 2nd Amendment challenge to Chicago’s ban on handguns, signaled Tuesday that they were ready to extend gun rights nationwide, clearing the way for legal attacks on state and local gun restrictions.

The court’s majority appears almost certain to strike down a Chicago ordinance and rule that residents have a right to a handgun at home. Of U.S. cities, only Chicago and its Oak Park suburb have total bans on handguns. But many cities and states have laws regulating who can have a gun and where they can take it.

Gun rights advocates have said they’ve been waiting for the court’s ruling in this case to begin challenging gun regulations nationwide.

At one point in Tuesday’s argument, Chief Justice John G. Roberts Jr. noted the city’s lawyers doubted that people had a right to carry concealed weapons in public.

“Well, maybe that’s right,” Roberts said. But he quickly added that the question could be left for a future case, indicating that the court was not likely to sweep away additional gun regulations in this ruling.

But the clear message from the argument is that a five-member majority on the court thinks the right “to bear arms” is a fundamental right, like the freedom of speech, that cannot be unduly restricted by federal regulations, state laws or city ordinances.

The Obama administration is raising the stakes in a fight over states’ rights and firearm ownership by arguing that new pro-gun laws in Montana and Tennessee are invalid.

In the last few months, a grass-roots, federalist revolt against Washington, D.C. has begun to spread through states that are home to politically active gun owners. Montana and Tennessee have enacted state laws saying that federal rules do not apply to firearms manufactured entirely within the state, and similar bills are pending in Texas, Alaska, Minnesota, and South Carolina.

Yet the Bureau of Alcohol, Tobacco, and Firearms, and Explosives now claims that that not only is such a state law invalid, but “because the act conflicts with federal firearms laws and regulations, federal law supersedes the act.”

Tennessee’s law already has taken effect. The BATF’s letter on July 16 to firearms manufacturers and dealers in the state says “federal law requires a license to engage in the business of manufacturing firearms or ammunition, or to deal in firearms, even if the firearms or ammunition remain within the same state.”

A similar letter was sent to manufacturers and dealers in Montana, where the made-in-the-state law takes effect on October 1, 2009. Neither law permits certain large caliber weapons or machine guns, and both would bypass federal regulations including background checks for buyers and record-keeping requirements for sellers.

While this federalism-inspired revolt has coalesced around gun rights, the broader goal is to dust off a section of the Bill of Rights that most Americans probably have paid scant attention to: the Tenth Amendment. It says that “powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

Read literally, the Tenth Amendment seems to suggest that the federal government’s powers are limited only to what it has been “delegated,” and the U.S. Supreme Court in 1918 confirmed that the amendment “carefully reserved” some authority “to the states.” That view is echoed by statements made at the time the Constitution was adopted; New Hampshire explicitly said that states kept “all powers not expressly and particularly delegated” to the federal government.
