An Afghan woman jailed for adultery after she was raped by a relative is set to be freed – but only after agreeing to marry the man who attacked her.

The case, which has highlighted the plight of Afghan women jailed for so-called moral crimes, was to be the subject of a documentary film funded by the European Union – until diplomats censored it out of fear for the woman’s welfare, and for their relations with the Afghan government.

But the decision not to broadcast the film, unintentionally led to a storm of publicity that has resulted in the Afghan president, Hamid Karzai, intervening in the case of the 19-year-old woman, named Gulnaz.

Karzai, who will soon head to an international conference on Afghanistan in Bonn to seek financial support from foreign donors, ordered Gulnaz to be released on condition that she and her attacker agree to mediation.

In a statement released on Thursday night, the presidential palace said Gulnaz would be released after she agreed to become the second wife of her rapist – a prospect that supporters say she had dreaded.

In Afghan culture, marrying the father of a child born out of wedlock is seen as a way of “legitimising” the child, even in cases involving rape.

The documentary’s British director, Clementine Malpas, said Gulnaz’s decision would have been made under duress. “She has told me that the rapist had destroyed her life because no one else would marry her after what happened to her,” Malpas said. “She feels like she has no other option than to marry him and it’s the only way to bring peace between her and his family.

“I know she wants honour but I also know she doesn’t want to marry this man. And of course I am worried about what the future holds for her because of this decision.”

(THE HAGUE, Netherlands) — Clergy sex abuse victims upset that no high-ranking Roman Catholic leaders have been prosecuted for sheltering guilty priests have turned to the International Criminal Court, seeking an investigation of the pope and top Vatican cardinals for possible crimes against humanity. The Vatican called the move a “ludicrous publicity stunt.”

The Center for Constitutional Rights, a New York-based nonprofit legal group, requested the inquiry Tuesday on behalf of the U.S.-based Survivors Network of those Abused by Priests, arguing that the global church has maintained a “long-standing and pervasive system of sexual violence” despite promises to swiftly oust predators.

The Vatican’s U.S. lawyer, Jeffrey Lena, called the complaint a “ludicrous publicity stunt and a misuse of international judicial processes” in a statement to The Associated Press.

The complaint names Pope Benedict XVI, partly in his former role as leader of the Vatican’s Congregation for the Doctrine of the Faith, which in 2001 explicitly gained responsibility for overseeing abuse cases; Cardinal William Levada, who now leads that office; Cardinal Angelo Sodano, the Vatican secretary of state under Pope John Paul II; and Cardinal Tarcisio Bertone, who now holds that post.

Veterans say rape cases mishandled (AP):

WASHINGTON – A group of U.S. veterans who say they were raped and abused by their comrades want to force the Pentagon to change how it handles such cases.

More than a dozen female and two male current or former service members say servicemen get away with rape and other sexual abuse and victims are too often ordered to continue to serve alongside those they say attacked them.

In a federal class-action lawsuit filed Tuesday that names Defense Secretary Robert Gates and his predecessor, Donald Rumsfeld, they want an objective third party to handle such complaints because individual commanders have too much say in how allegations are handled.

The alleged attackers in the lawsuit include an Army criminal investigator and an Army National Guard commander. The abuse alleged ranges from obscene verbal abuse to gang rape.

Vatican Warned Irish Bishops Not to Report Child Abuse

DUBLIN (AP) — A 1997 letter from the Vatican warned Ireland’s Catholic bishops not to report all suspected child-abuse cases to police — a disclosure that victims’ groups described as “the smoking gun” needed to show that the church enforced a worldwide culture of covering up crimes by pedophile priests.

The newly revealed letter, obtained by Irish broadcasters RTE and provided to The Associated Press, documents the Vatican’s rejection of a 1996 Irish church initiative to begin helping police identify pedophile priests following Ireland’s first wave of publicly disclosed lawsuits.

The letter undermines persistent Vatican claims, particularly when seeking to defend itself in U.S. lawsuits, that Rome never instructed local bishops to withhold evidence or suspicion of crimes from police. It instead emphasizes the church’s right to handle all child-abuse allegations and determine punishments in house rather than give that power to civil authorities.

Signed by the late Archbishop Luciano Storero, Pope John Paul II’s diplomat to Ireland, the letter instructs Irish bishops that their new policy of making the reporting of suspected crimes mandatory “gives rise to serious reservations of both a moral and canonical nature.”

Storero wrote that canon law, which required abuse allegations and punishments to be handled within the church, “must be meticulously followed.” Any bishops who tried to impose punishments outside the confines of canon law would face the “highly embarrassing” position of having their actions overturned on appeal in Rome, he wrote.

Some people think Ratzinger’s critics are holding him responsible for acts that were carried out before he became Pope, simply because he is the head of the institution involved. This is an error. For over 25 years, Ratzinger was personally in charge of the Congregation for the Doctrine of the Faith, the part of the Vatican responsible for enforcing Catholic canonical law across the world, including on sexual abuse. He is a notorious micro-manager who, it is said, insisted every salient document cross his desk. Hans Küng, a former friend of Ratzinger’s, says: “No one in the whole of the Catholic Church knew as much about abuse cases as this Pope.”

We know what the methods of the church were during this period. When it was discovered that a child had been raped by a priest, the church swore everybody involved to secrecy, and moved the priest on to another parish. When he raped more children, they too were sworn to secrecy, and he was moved on to another parish. And on, and on. Over 10,000 people have come forward to say they were raped as part of this misery-go-round. The church insisted all cases be kept from the police and dealt with by their own “canon” law – which can only “punish” child rapists to prayer or penitence or, on rare occasions, defrocking.

Ratzinger was at the heart of this. He refuses to let any police officer see the Vatican’s documentation, even now, but honourable Catholics have leaked some of them anyway. We know what he did. We have the paper trail. Here are three examples.

In Germany in the early 1980s, Father Peter Hullermann was moved to a diocese run by Ratzinger. He had already been accused of raping three boys. Ratzinger didn’t go to the police, instead Hullermann was referred for “counselling”. The psychiatrist who saw him, Werner Huth, told the Church unequivocally that he was “untreatable [and] must never be allowed to work with children again”. Yet he kept being moved from parish to parish, even after a sex crime conviction in 1986. He was last accused of sexual abuse in 1998.

In the US in 1985, a group of American bishops wrote to Ratzinger begging him to defrock a priest called Father Stephen Kiesle, who had tied up and molested two young boys in a rectory. Ratzinger refused for years, explaining that he was thinking of the “good of the universal Church” and of the “detriment that granting the dispensation can provoke among the community of Christ’s faithful, particularly considering the young age” of the priest involved. He was 38. He went on to rape many more children. Think about what Ratzinger’s statement reveals. Ratzinger thinks the “good of the universal Church” – your church – lies not in protecting your children from being raped, but in protecting the rapists from punishment.

In 1996, the Archbishop of Milwaukee appealed to Ratzinger to defrock Father Lawrence C Murphy, who had raped and tortured up to 200 deaf and mute children at a Catholic boarding school. His rapes often began in the confessional. Ratzinger never replied. Eight months later, there was a secret canonical “trial” – but Murphy wrote to Ratzinger saying he was ill, so it was cancelled. Ratzinger advised him to take a “spiritual retreat”. He died years later, unpunished.

These are only the cases that have leaked out. Who knows what remains in the closed files? In 2001, Ratzinger wrote to every bishop in the world, telling them allegations of abuse must be dealt with “in absolute secrecy… completely suppressed by perpetual silence”. That year, the Vatican actually lauded Bishop Pierre Pican for refusing to inform the local French police about a paedophile priest, telling him: “I congratulate you for not denouncing a priest to the civil administration.” The commendation was copied to all bishops.

The Vatican has rejected the resignations of two Catholic bishops in Ireland who offered to quit in the wake of a child sex abuse scandal, the Archbishop of Dublin said.

Archbishop Diarmuid Martin said in a letter to priests in his archdiocese that Auxiliary Bishops Eamonn Walsh and Raymond Field will remain in their jobs but will be given “revised responsibilities”.

The bishops presented their resignations to Pope Benedict XVI in December following a judge’s damning report on the Dublin archdiocese that found the Catholic Church concealed the abuse of children by priests for three decades.

In the letter he said: “Following the presentation of their resignations to Pope Benedict, it has been decided that Bishop Eamonn Walsh and Bishop Raymond Field will remain as auxiliary bishops.”

The archbishop said they were “to be assigned revised responsibilities within the diocese.”

“This means that they will be available to administer confirmation in any part of the diocese in the coming year,” Martin added.

US Military Judge: Confessions Obtained By Threatening The Subject With Rape Are Admissible In Court

In one of the first military commissions held under the Obama administration, a US military judge has ruled that confessions obtained by threatening the subject with rape are admissible in court.

The case involves Omar Ahmed Khadr, a citizen of Canada who was apprehended in Afghanistan when he was 15 years old for the last seven years awaiting trial for terrorism and war crimes. and has remained in Guantanamo Bay

As AFP reported on Monday,

Khadr, now 23, is accused of throwing a grenade in 2002 that killed a US soldier. He also is alleged to have been trained by Al-Qaeda and joined a network organized by Osama bin Laden to make bombs.

“It’s very clear that the government of the US and the government of Canada have decided not to intervene in this case and therefore we are going to see the first case of a child soldier in modern history,” said his military lawyer Jon Jackson.

“When President Obama was elected, I believed that we were going to close the book on Guantanamo and the military commissions. And instead President Obama has decided to write the next sad, pathetic chapter in the book of the military commissions,” he added.

In addition to being a child soldier, there is evidence that Khadr’s confession was obtained though the use of threats of violence and death.

In May hearings, a man identified as Interrogator 1 said in testimony that he threatened Mr. Khadr with being gang-raped to death if he did not co-operate. That interrogator was later identified as former U.S. Army Sergeant Joshua Claus. He has also been convicted of abusing a different detainee and has left the military.

Mr. Khadr’s military-appointed lawyer, Lieutenant-Colonel Jon Jackson, argued this instance, as well as other alleged instances of torture and coercion, are enough to render any future confessions – even those in so-called “clean” interrogations – inadmissible in court.

Although Khadr’s confessions were obtained in this manner, the military judge presiding over the case ruled they are still admissible as evidence.

Another Guantanamo detainee, a former bodyguard of Osama bin Laden, has already entered a plea agreement, but information about his sentence has been sealed by a US military judge.

The Vatican has confirmed the authenticity of a letter in which a cardinal praised a French bishop for not denouncing a paedophile priest.

The letter, originally published in the French press, was written in 2001 by Cardinal Dario Castrillon Hoyos, then in charge of clergy around the world.

A Vatican spokesman said the letter showed the wisdom of a 2001 decision to centralise the handling of abuse cases.

The case comes amid a continuing child sex abuse scandal engulfing the Church.

Allegations of abuse and cover-ups have emerged recently from countries across Europe as well as the US.

The letter from Cardinal Hoyos was addressed to the bishop of Bayeux-Lisieux in northern France, Pierre Pican.

Father Pican had just been given a three-month suspended prison sentence for not denouncing Rene Bissey, an abbott who was sentenced to 18 years in prison in 2000 for paedophilia.

‘Delighted’

“I congratulate you on not having spoken out to civil authorities against a priest,” wrote Cardinal Dario Castrillon Hoyos, who at the time was prefect of the Congregation for the Clergy.

That step was taken in 2001 by Cardinal Joseph Ratzinger – now Pope Benedict XVI – who headed the the Congregation for the Doctrine of the Faith at the time.

BELGIAN bishops have failed to punish any clergy over 300 complaints of paedophilia brought to their attention in the 1990s, claims a priest who helped many victims.

”We brought forward between 1992 and 1998 more than 300 complaints from victims of abuse committed by priests, but only 15 ended up with admissions” of guilt, Father Rick Deville told the Flemish dailies De Standaard and Het Nieuwsblad yesterday.

”A priest accused would most often be moved, but was never punished,” he complained.

Hartford, Connecticut (CNN) — A bill in Connecticut’s legislature that would remove the statute of limitations on child sexual abuse cases has sparked a fervent response from the state’s Roman Catholic bishops, who released a letter to parishioners Saturday imploring them to oppose the measure.

Under current Connecticut law, sexual abuse victims have 30 years past their 18th birthday to file a lawsuit. The proposed change to the law would rescind that statute of limitations.

The proposed change to the law would put “all Church institutions, including your parish, at risk,” says the letter, which was signed by Connecticut’s three Roman Catholic bishops.

Germany’s justice minister accused the Vatican today of covering up severe sexual abuse in the Church after fresh reports surfaced at three Catholic schools in Bavaria.

Sabine Leutheusser-Schnarrenberger called the developments “frightening” after the cathedral choir in Regensburg, the Benedictine monastery school at Ettal and a Capucian school in Burghausen revealed new cases of sexual and physical abuse.

The revelations followed reports last month that Catholic priests had sexually abused over 100 children at Jesuit schools around Germany, which led to a public apology from Archbishop Robert Zollitsch, head of the German Bishops Conference.

“In many schools there was a wall of silence allowing for abuse and violence,” Ms Leutheusser-Schnarrenberger, a secular liberal politician who has been the government’s leading critic of the Church, told Germany’s Deutschlandfunk radio.

“Even the most severe cases of abuse are subject only to papal secrecy and should not be disclosed outside the Church,” she said, citing a 2001 Catholic congregation directive.

Church officials rejected her charges. Bishop Stephan Ackermann, who speaks for the Church on abuse matters, called the minister’s comments “absurd”.

“Our guidelines insist that we involve state prosecutors,” he told the Frankfurter Allgemeine Zeitung newspaper.

“The lawsuit claims Father Fiala gave the teen a ride in a church truck to Big Spring for the teen to visit his girlfriend but stopped at a San Angelo Motel 6. There, he raped the teen at gunpoint in a room and said, “If you tell anyone what happened, I will hurt you and your family,” according to the suit.

On other occasions, the priest manipulated the teen into performing oral sex, once by leveraging his gift of a car and another time pulling a revolver on him, according to the suit.

The teen eventually ran away from home and attempted suicide, the suit says. A school counselor learned of the alleged abuse and contacted the Sheriff’s Office.”

A Catholic priest from a rural parish west of San Antonio is accused in a lawsuit filed Thursday of sexually assaulting a 16-year-old boy at gunpoint and during private catechism sessions two years ago.

The suit, which names outgoing Archbishop José Gomez as a defendant and claims he sought to conceal the matter, comes three days after the Vatican named Gomez as the next archbishop in Los Angeles.

Norway Catholic Church Computer Server Crashed By Flood Of Pedophile Priests Abuse Claims

(AFP) — Norway’s Roman Catholic Church received so many email tip-offs about possible pedophile priests following revelations of abuse by a bishop that its computer crashed, a senior cleric said.

“I received so many email tip-offs about possible aggressions and other sexual abuse that the computer server crashed,” Bishop of Oslo and Trondheim Bernt Eidsvig was quoted as saying by the tabloid paper Verdens Gang.

Bernt disclosed on Wednesday at the request of the Vatican that one of Norway’s former bishops, German Georg Mueller, had abused a choirboy in the early 1990s.

7-year-old girl gang-raped by two adults and three juveniles after 15-year-old stepsister sold her during a party

TRENTON, N.J. (AP) — Two adults and three juveniles have been charged with gang-raping a 7-year-old girl who police say was sold by her 15-year-old stepsister during a party at a crime-ridden New Jersey apartment building.

Details on the arrests were announced at a Saturday night news conference at police headquarters in Trenton, the state’s capital city.

The arrested people include a 20-year-old man who already had been charged Friday with having sex with the 15-year-old. The other four are a 19-year-old Trenton man and three boys ages 13, 14 and 17. Each is charged with aggravated sexual assault and child endangerment.

Police say further arrests may be made.

Ireland Archbishop Stunned by Archbishop of Canterbury’s Criticism of Catholic Church

The Archbishop of Dublin today said he was “stunned” to hear the Archbishop of Canterbury declare that the Roman Catholic Church in Ireland has lost all credibility because of the child abuse scandal.

Diarmuid Martin, the second most senior Catholic in Ireland, responded to a rare breach of ecumenical protocol by Dr Rowan Williams in an interview with BBC Radio 4.

Mr Martin said he had “rarely felt personally so discouraged” as when he woke to hear Dr Williams’ comments. Those working to renew the church did not deserve the remarks, which “will be for them immensely disheartening and will challenge their faith even further”.

It comes after Dr Williams said the paedophile priest scandal had been a “colossal trauma” for Ireland in particular as he commented for the first time on the crisis.

“I was speaking to an Irish friend recently who was saying that it’s quite difficult in some parts of Ireland to go down the street wearing a clerical collar now,” he told Andrew Marr for the BBC Radio 4 programme Start the Week, to be broadcast on Monday.

“And an institution so deeply bound into the life of a society suddenly becoming, suddenly losing all credibility — that’s not just a problem for the Church, it is a problem for everybody in Ireland.”

Rachel Mike, who won a settlement in a case involving Father Poole, at her confirmation in the summer of 1975. Behind her is Father George Endal, accused of raping or molesting several boys and allegedly walking in on another priest performing oral sex on a 6-year-old boy and doing nothing to stop it.

One spring afternoon in 1977, 15-year-old Rachel Mike tried to kill herself for the third time. An Alaska Native, Rachel was living in a tiny town called Stebbins on a remote island called St. Michael. She lived in a house with three bedrooms and nine siblings. Rachel was a drinker, depressed, and starving. “When my parents were drinking, we didn’t eat right,” she says. “I just wanted to get away from the drinking.”

Rachel walked to the bathroom to fetch the family rifle, propped in the bathtub with the dirty laundry (the house didn’t have running water). To make sure the gun worked, Rachel loaded a shell and blew a hole in her bedroom wall. Her father, passed out on his bed, didn’t hear the shot. Rachel walked behind their small house. Her arms were too short to put the rifle to her head, so she shot herself in her right leg instead.

Rachel was found screaming in a pool of blood by her Auntie Emily and flown 229 miles to a hospital in Nome. The doctor asked if she wanted to see a priest. She said yes. In walked Father James Poole-a popular priest, radio personality on KNOM, and, according to allegations in at least five lawsuits, serial child rapist. Father Poole has never been convicted of a crime, but the Jesuits have settled numerous sex-abuse claims against him since 2005, in excess of $5 million, according to an attorney involved in four of those five lawsuits. Exact figures aren’t available because some of the settlements involve confidentiality agreements. The Jesuits have never let a single case against Father Poole go to trial.

In a 2005 deposition, Rachel testified that she had been molested by Father Poole in 1975, while in Nome for her second suicide attempt, an attempted overdose of alcohol and pills. He’d come sit by her bed, put his hand under the hospital blanket, and fondle her, she said.

She traveled between Stebbins and Nome several times in the late 1970s, spending time in hospitals and receiving homes. By 1977, Rachel testified, Poole had given her gonorrhea, and by 1978 she was pregnant with his child. In an interview with The Stranger, she said Poole encouraged her to get an abortion and tell the doctors she had been raped by her father. She followed his advice. “He brainwashed me,” she said. “He messed up my head, man.”

Rachel Mike’s father died in 2004. A year later, she heard Elsie Boudreau, another survivor of Poole’s abuse, being interviewed on the radio. Listening to Boudreau, Rachel was moved to finally tell the truth.

Years after her controversial ‘Saturday Night Live’ appearance, the Irish singer is still at odds with the Catholic Church, saying it must come clean about sexual-abuse allegations.

Reporting from Bray, Ireland – She shot to fame 20 years ago with her shaved head, chiseled cheeks and haunting rendition of the song “Nothing Compares 2 U.” Then she gained notoriety when she tore up a photo of Pope John Paul II on American TV, calling him “the enemy” and urging people to fight child abuse.

Sinead O’Connor is still singing. And she’s still speaking out against abuse — only now her 1992 stunt on “Saturday Night Live” almost seems prescient as the Roman Catholic Church faces a growing catalog of complaints about child sexual and physical assault by priests in her Irish homeland and across Europe.

Such mistreatment was rampant here in Ireland, going back decades. By 1987, the Irish church was alarmed enough that it took out an insurance policy against future lawsuits and claims for compensation stemming from sexual-abuse allegations.

This past weekend, Pope Benedict XVI issued a “pastoral letter” apologizing to the flock in Ireland for the church’s past failures. He did not outline any disciplinary action against the bishops who many here say covered up priestly misdeeds, though on Wednesday he accepted the resignation of Bishop John Magee, who had been accused of failing to report suspected pedophile priests to police. The pope also pinned no blame on the Vatican itself for a culture of secrecy that critics say it deliberately fostered.

O’Connor, now 43 and a mother of four, spoke to The Times on Tuesday at her seaside home in Bray, south of Dublin, about the abuse scandal.

Do you feel the pope’s letter was enough?

It’s a study in the fine art of lying and actually betraying your own people. . . . He starts by saying that he’s writing with great concern for the people of Ireland. If he was that concerned, why has it taken him 23 years to write a letter, and why did he or the last pope never get on an airplane and come to meet the victims in any of these countries and apologize?

The letter sells the Irish [church] hierarchy downriver by stating again and again that the Irish hierarchy has somehow acted independently of the Vatican. . . . The documents are there to prove that that’s a lie. . . .

If you were the boss of a company and some of the employees of your company were known to sexually abuse children, you would fire them instantly. You would also go instantly to meet the people who had been abused and profusely apologize and offer your help in any way whatsoever to deal with this. . . . That has never happened.

As a cardinal, the pope wrote an order in 2001 demanding that abuse cases be dealt with in secret. But doesn’t the directive also mention cooperating with civil authorities?

Irish Catholic Church Paid Child Sex Abuse Victim To Keep Quiet

Reports of settlement overseen by bishop of Derry adds to abuse scandals surrounding Catholic churches in Europe

The Catholic church in Ireland was today embroiled in another child abuse scandal after allegations that a victim was paid to keep quiet in a deal overseen by the bishop of Derry.

Bishop Seamus Hegarty was named as a party in a confidential civil settlement after a woman claimed she was abused by a priest for more than a decade, according to a report in today’s Belfast Telegraph. According to the newspaper, the claim was settled without admission of liability but with a payment of £12,000 to the alleged victim. The settlement between the archdiocese of Derry and the woman, who was eight when the abuse began, reportedly contained a confidentiality clause preventing her from discussing the case.

Her ordeal allegedly began in 1979 and lasted for a decade before she revealed at her 18th birthday party that she had been repeatedly abused by the priest.

The allegation came as further developments in similar abuse scandals in Germany and Austria compounded the woes of Pope Benedict XVI. In Germany, the archbishop of Munich, Reinhard Marx, said Catholic bishops in Benedict’s home state of Bavaria felt “deep consternation and shame” at the reports of abuse.

Catholic Church Child Abuse: Nuns Now Also Accused

Following recent reports about sexual abuse of children by Dutch priests, it now appears that some nuns also took advantage of their charges. Tuesday’s edition of newspaper De Telegraaf contains the story of Herman Harends, who says he was abused by nuns at a Roman Catholic boarding school he attended in the 1950s.

Radio Netherlands Worldwide and newspaper NRC Handelsblad published their report on sexual abuse within the Roman Catholic church two weeks ago. Since then, more and people have come forward, saying they, too, were childhood victims.

Mr Harends and his two brothers attended a boarding school in the southern Dutch town of Tegelen.
“I have not spoken out before because it is a hard claim to substantiate,” he explains, “I’m not looking for atonement or apologies, most of the nuns have died.”

“The abuse by the sisters started when I was 11. When I was in the bath they played with my penis and tried to give me an erection … They would also put my hand under their robes and into their underwear.”
