BP says Halliburton ‘destroyed evidence’ over Deepwater blast to protect itself from blame (Daily Mail, Dec. 6, 2011):

Oil giant BP has accused Halliburton of intentionally destroying vital evidence relating to last year’s Deepwater Horizon disaster.

Eleven men died in the oil well blast which led to the world’s largest accidental offshore oil spill in the Gulf of Mexico.

Oil services group Halliburton was one of the principal contractors on the project at the time of the accident.

It had been working on cement to seal the well to prevent leaks of oil and gas, the results of which BP says have been obscured.

Today, BP asked a federal judge to punish the firm.

The accusation raises the stakes ahead of a trial, expected at the end of February, to assign blame and damages for the April 2010 explosion.

Citing recent depositions and Halliburton’s own documents, BP said Halliburton ‘intentionally’ destroyed the results of slurry testing for the well.

BP said it was done in part to ‘eliminate any risk that this evidence would be used against it at trial’.

The oil company also said Halliburton appeared to have lost computer evidence showing how the cement performed, with Halliburton maintaining that the information is simply ‘gone’.

BP asked U.S. District Judge Carl Barbier in New Orleans, who oversees spill litigation, to sanction Halliburton by ruling that Halliburton’s slurry design was ‘unstable,’ a finding of fact that could be used at trial.

It also asked Barbier to direct that forensic experts be hired to find the missing computer data.

‘These remedies are amply warranted in law and by principles of fair play, and they are essential to ensure this court’s trial is not tainted by Halliburton’s misconduct,’ BP said in the filing.

Halliburton is the world’s second-largest oilfield services provider. A spokeswoman, Beverly Blohm Stafford, said the Houston-based company is reviewing BP’s filing.

‘We believe that the conclusion that BP is asking the court to draw is without merit and we look forward to contesting their motion in court,’ she said.

The Deepwater Horizon drilling rig’s explosion on April 20, 2010, caused 11 deaths, and brought tens of billions of dollars of lawsuits. Halliburton has accused BP of fraud and defamation, among other claims.

BP has also sued Transocean Ltd, which owned the rig, and Cameron International Corp, which made a blowout preventer.

In October, Anadarko Petroleum Corp, which owned 25 per cent of the well, agreed to pay BP $4billion toward clean-up costs and victims compensation.

BP has also reached settlements with Mitsui & Co, whose MOEX Offshore 2007 LLC venture was a drilling partner, and Weatherford International Ltd, which provided equipment used in the well.

AP IMPACT: Fed’l Inspections on Rig Not as Claimed:

The federal agency responsible for ensuring that an oil rig in the Gulf of Mexico was operating safely before it exploded last month fell well short of its own policy that inspections be done at least once per month, an Associated Press investigation shows.

Since January 2005, the federal Minerals Management Service conducted at least 16 fewer inspections aboard the Deepwater Horizon than it should have under the policy, a dramatic fall from the frequency of prior years, according to the agency’s records.

Gulf of Mexico: Scientists Find Giant Plumes of Oil as Large as 10 Miles Long, 3 Miles Wide And 300 Feet Thick in Deep Waters:

Scientists studying video of the gushing oil well have tentatively calculated that it could be flowing at a rate of 25,000 to 80,000 barrels of oil a day. The latter figure would be 3.4 million gallons a day.

“The Gulf of Mexico is a very big ocean. The amount of volume of oil and dispersant we are putting into it is tiny in relation to the total water volume.”

Approximately 325,000 gallons of dispersant have been deployed so far in BP’s effort to break up the spreading oil slick before it hits the fragile Gulf coast, and over 500,000 gallons more are available.
