The FBI has drawn criticism over its apparent use of ‘entrapment’ tactics.

David Williams did not have an easy life. He moved to Newburgh, a gritty, impoverished town on the banks of the Hudson an hour or so north of New York, at just 10 years old. For a young, black American boy with a father in jail, trouble was everywhere.

Williams also made bad choices. He ended up going to jail for dealing drugs. When he came out in 2007 he tried to go straight, but money was tight and his brother, Lord, needed cash for a liver transplant. Life is hard in Newburgh if you are poor, have a drug rap and need cash quickly.

His aunt, Alicia McWilliams, was honest about the tough streets her nephew was dealing with. “Newburgh is a hard place,” she said. So it was perhaps no surprise that in May, 2009, David Williams was arrested again and hit with a 25-year jail sentence. But it was not for drugs offences. Or any other common crime. Instead Williams and three other struggling local men beset by drug, criminal and mental health issues were convicted of an Islamic terrorist plot to blow up Jewish synagogues and shoot down military jets with missiles.

Even more shocking was that the organisation, money, weapons and motivation for this plot did not come from real Islamic terrorists. It came from the FBI, and an informant paid to pose as a terrorist mastermind paying big bucks for help in carrying out an attack. For McWilliams, her own government had actually cajoled and paid her beloved nephew into being a terrorist, created a fake plot and then jailed him for it. “I feel like I am in the Twilight Zone,” she told the Guardian.

Lawyers for the so-called Newburgh Four have now launched an appeal that will be held early next year. Advocates hope the case offers the best chance of exposing the issue of FBI “entrapment” in terror cases. “We have as close to a legal entrapment case as I have ever seen,” said Susanne Brody, who represents another Newburgh defendant, Onta Williams.

Some experts agree. “The target, the motive, the ideology and the plot were all led by the FBI,” said Karen Greenberg, a law professor at Fordham University in New York, who specialises in studying the new FBI tactics.

But the issue is one that stretches far beyond Newburgh. Critics say the FBI is running a sting operation across America, targeting – to a large extent – the Muslim community by luring people into fake terror plots. FBI bureaux send informants to trawl through Muslim communities, hang out in mosques and community centres, and talk of radical Islam in order to identify possible targets sympathetic to such ideals. Or they will respond to the most bizarre of tip-offs, including, in one case, a man who claimed to have seen terror chief Ayman al-Zawahiri living in northern California in the late 1990s.

That tipster was quickly hired as a well-paid informant. If suitable suspects are identified, FBI agents then run a sting, often creating a fake terror plot in which it helps supply weapons and targets. Then, dramatic arrests are made, press conferences held and lengthy convictions secured.

But what is not clear is if many real, actual terrorists are involved.

NYPD Monitors Everyone In The City Who Changes His Or Her Name

NYPD keeps files on Muslims who change their names (AP, Oct. 27, 2011):

NEW YORK (AP) — For generations, immigrants have shed their ancestral identities and taken new, Americanized names as they found their place in the melting pot. For Muslims in New York, that rite of assimilation is now seen by police as a possible red flag in the hunt for terrorists.

The New York Police Department monitors everyone in the city who changes his or her name, according to interviews and internal police documents obtained by The Associated Press. For those whose names sound Arabic or might be from Muslim countries, police run comprehensive background checks that include reviewing travel records, criminal histories, business licenses and immigration documents.

All this is recorded in police databases for supervisors, who review the names and select a handful of people for police to visit.

The program was conceived as a tripwire for police in the difficult hunt for homegrown terrorists, where there are no widely agreed upon warning signs. Like other NYPD intelligence programs created in the past decade, this one involved monitoring behavior protected by the First Amendment.

The DOJ’s Escalating Criminalization Of Speech

Over the past several years, the Justice Department has increasingly attempted to criminalize what is clearly protected political speech by prosecuting numerous individuals (Muslims, needless to say) for disseminating political views the government dislikes or considers threatening.  The latest episode emerged on Friday, when the FBI announced the arrest and indictment of Jubair Ahmad, a 24-year-old Pakistani legal resident living in Virginia, charged with “providing material support” to a designated Terrorist organization (Lashkar-e-Tayyiba (LeT)).

What is the “material support” he allegedly gave?  He produced and uploaded a 5-minute video to YouTube featuring photographs of U.S. abuses in Abu Ghraib, video of armored trucks exploding after being hit by IEDs, prayer messages about “jihad” from LeT’s leader, and — according to the FBI’s Affidavit — “a number of terrorist logos.”  That, in turn, led the FBI agent who signed the affidavit to assert that “based on [his] training and experience, it is evident that the video . . . is designed as propaganda to develop support for LeT and to recruit jihadists to LeT.”  The FBI also claims Ahmad spoke with the son of an LeT leader about the contents of the video and had attended an LeT camp when he was a teenager in Pakistan.  For the act of uploading that single YouTube video (and for denying that he did so when asked by the FBI agents who came to his home to interrogate him), he faces 23 years in prison.

Let’s be very clear about the key point: the Constitution — specifically the Free Speech clause of the First Amendment — prohibits the U.S. Government from punishing someone for the political views they express, even if those views include the advocacy of violence against the U.S. and its leaders.  One can dislike this legal fact.  One can wish it were different.  But it is the clear and unambiguous law, and has been since the Supreme Court’s unanimous 1969 decision in Brandenburg v. Ohio, which overturned the criminal conviction of a Ku Klux Klan leader who had publicly threatened violence against political officials in a speech.

Christian, Jewish and Muslim Leaders OK U.N. Agenda 21 For Sustainable Development?

Holy Land clerics launch interfaith Earth forum (AFP, July 25, 2011):

Christian, Jewish and Muslim leaders in the Holy Land joined forces Monday to launch a multi-faith environmental campaign, citing religious injunctions to protect the Earth across their three faiths.

Among their plans are the convening of an international conference of religious leaders in New York ahead of the 2012 UN General Assembly, a North America public relations campaign and training future clerics on the importance of environmental issues, one of the organisers said.

At the Jerusalem launch of the Interfaith Centre for Sustainable Development, rabbi David Rosen noted that the obligation upon humans to care for their surroundings comes near the very beginning of the Bible.

“That is the original charge in the first chapters of Genesis, given to the first man and woman, not purely to develop, to till the land, but also to protect it… to conserve it,” he said, to nods of agreement from a Roman Catholic bishop and the Palestinian deputy minister of religious affairs.

“The main religions should really study the ecological crisis together, because our destiny is common,” bishop William Shomali said. “If Earth is polluted it is polluted for Muslims, Christian and Jews.”

Laying out the centre’s plan of action, rabbi Yonatan Neril said that the campaign was not limited to monotheistic faiths.

“(One) project is to have a speaking tour of North America of Muslim, Christian, and Jewish religious teachers, as well as Hindu and Buddhist teachers, to raise awareness about environmental sustainability from a faith perspective, he said.

The German State of Hesse Bans The Burka, Risks Muslim Anger

A German state yesterday became the first region in the country to ban Muslim women from wearing burkas.

The country has been gripped for several months by an angry debate on multiculturalism with many Germans voicing their concerns over immigration.

Hesse, a state run by Chancellor Angela Merkel’s Christian Democrats, has now became the first German region to ban Muslim face veils for public sector workers.

Hesse Interior Minister Boris Rheinsaid it was ‘not acceptable’ for a teacher in Frankfurt to wear a face veil because ‘public sector workers are obligated to have neutral religious and political views’.

The decision was prompted by a local teacher who had told her school she wanted to wear a burka in the classroom after returning from maternity leave. She had not previously worn one.

Debates about outlawing burkas have spread across Europe after France banned the Muslim face veils.

CIA Chief Sees Unrest Rising With Population

Swelling populations and a global tide of immigration will present new security challenges for the United States by straining resources and stoking extremism and civil unrest in distant corners of the globe, CIA Director Michael V. Hayden said in a speech yesterday.

The population surge could undermine the stability of some of the world’s most fragile states, especially in Africa, while in the West, governments will be forced to grapple with ever larger immigrant communities and deepening divisions over ethnicity and race, Hayden said.

Hayden, speaking at Kansas State University, described the projected 33 percent growth in global population over the next 40 years as one of three significant trends that will alter the security landscape in the current century. By 2050, the number of humans on Earth is expected to rise from 6.7 billion to more than 9 billion, he said.

“Most of that growth will occur in countries least able to sustain it, a situation that will likely fuel instability and extremism, both in those countries and beyond,” Hayden said.

With the population of countries such as Niger and Liberia projected to triple in size in 40 years, regional governments will be forced to rapidly find food, shelter and jobs for millions, or deal with restive populations that “could be easily attracted to violence, civil unrest, or extremism,” he said.

Jacqui Smith announces 300 new terror police

Jacqui Smith, the Home Secretary, today announced an extra 300 police officers to fight terrorism and radicalisation within communities.


At the weekend Jacqui Smith warned that as many as 30 active plots against the UK were now being investigated

Miss Smith said that the new officers work to prevent young people being drawn into extremism.

The threat to Britain was “serious and growing” and, despite a series of successful raids and convictions, we cannot simply “arrest our way out” of the problem, she said.

British officials gave warning yesterday that America’s commander in Iraq will declare that Iran is waging war against the US-backed Baghdad government.

A strong statement from General David Petraeus about Iran’s intervention in Iraq could set the stage for a US attack on Iranian military facilities, according to a Whitehall assessment. In closely watched testimony in Washington next week, Gen Petraeus will state that the Iranian threat has risen as Tehran has supplied and directed attacks by militia fighters against the Iraqi state and its US allies.
