A U.S. judge is weighing whether to halt a lawsuit filed by a graduate student whose laptop was seized by customs agents as he crossed the border from Canada and found to contain pictures of rallies by Hamas and Hezbollah.

U.S. District Judge Robert Korman in Brooklyn, New York, yesterday put off ruling on whether to allow the case to go forward. Pascal Abidor, a 27-year-old U.S.-French dual citizen, represented by the American Civil Liberties Union, seeks to force border guards to show a “reasonable suspicion” before searching laptop computers and other devices.

Abidor brought the case against the U.S. Department of Homeland Security and its secretary, Janet Napolitano, in September, saying such seizures violated the constitutional rights to free speech and to protection against improper searches.

Lynsie Murley, 24, sued the TSA for negligence and intentional infliction of emotional distress after she was humiliated at Texas’s Corpus Christi airport in May of 2008.

Miss Murley, of Amarillo in Texas, claimed an agent pulled her blouse completely down, exposing her breasts to everyone in the area, after she was ‘singled out for extended search procedures’.

Texas lawmakers and federal agents came to a dramatic showdown last night, over a bill that would have prohibited Transportation Security Administration agents from conducting intrusive pat-downs. The Department of Justice circulated a letter that told the politicians if they went through with HB 1937, the TSA would cancel flights out of Texas.

Texas State Rep. David Simpson, who wrote the bill, put the ultimatum in more vibrant terms in a press release he issued today:

Either Texas backs off and continues to let government employees fondle innocent women, children and men as a condition of travel, or the TSA will cancel Texas flights. The Federal Government showed its willingness to bully the State of Texas if attempts to protect passengers from being forced to give up constitutional rights are not dropped.

In a letter to legislative leaders, the Department of Justice said the bill “would conflict directly with federal law.”

“Under the Supremacy Clause of the United States Constitution, Texas has no authority to regulate federal agents and employees in the performance of their federal duties or to pass a statute that conflicts with federal law,” John Murphy, an United States attorney, wrote in the letter.

Reuters reports that the bill would have made “intrusive touching” a crime punishable by up to a year of jail-time:

The bill described “intrusive touching” as touching a passenger’s sexual organs, or “touching in a manner that would be offensive to a reasonable person.”

• The names of the researchers who conducted the radiation tests at Rapidscan have been kept secret! This means the researchers are not available for scientific questioning of any kind, and there has been no opportunity to even ask whether they are qualified to conduct such tests. TSA to retest airport body scanners for radiation

The Transportation Security Administration announced Friday that it would retest every full-body X-ray scanner that emits ionizing radiation – 247 machines at 38 airports – after maintenance records on some of the devices showed radiation levels 10 times higher than expected.

The TSA says that the records reflect math mistakes and that all the machines are safe. Indeed, even the highest readings listed on some of the records – the numbers that the TSA says were mistakes – appear to be many times less than what the agency says a person absorbs through one day of natural background radiation.

Even so, the TSA has ordered the new tests out of “an abundance of caution to reassure the public,” spokesman Nicholas Kimball says. The tests will be finished by the end of the month, and the results will be released “as they are completed,” the agency said on its website.

The lawmaker behind a bill Texas that would levy felony charges against overly-touchy security personnel may be staunchly Republican, but he truly believes his cause isn’t one tied to the political left or right.

“We’re talking about what would be a criminal act in any other place,” Rep. David Simpson (R) told Raw Story on Monday. “If you viewed someone naked without their permission or consent, or as a condition of travel, it would be sexual harassment or vouyerism. If you touched people’s privates, that would be sexual assault.

“This is not a left or right issue,” he added. “They are treating American citizens with great indignity, and we’ve got to make this right.”

Though unlikely to pass — even with a GOP supermajority in the Texas legislature — Simpson’s proposal has become a cause célèbre for civil libertarians, many of whom adamantly oppose the TSA’s screening procedures.

The bill would amend a Texas statute pertaining to “the offensive touching of persons,” extending it to security personnel who conduct a search “without probable cause.”

That’s actually the exact wording used in the Constitution in the section outlining prohibitions on unreasonable search and seizure. The legal standard for a lawful search is probable cause: a requirement that law enforcement must meet before most judges will issue search warrants.

New Hampshire Bill Would Make Some Airport Screening Sexual Assault

CONCORD, N.H. — Lawmakers and residents engaged in heated debate Tuesday over a bill that would make random airport security pat-downs and body scans criminal in New Hampshire.

The bill (HB628-FN) “makes the touching or viewing with a technological device of a person’s breasts or genitals by a government security agent without probable cause a sexual assault,” according to the introductory text of the bill.

“Let’s put their name on the sex offender registry, and maybe that will tell them New Hampshire means business,” said bill co-sponsor Rep. Andrew Manuse, R-Derry.

“That is a crime in this state, and we should charge them every single time,” said bill co-sponsor Rep. George Lambert, R-Litchfield.

Poor family in front of us! 9 year old getting patted down and wanded. They groped our people too and were very unprofessional. I am all about security, but when have you ever been harassed and felt up getting OFF a plane? Shouldn’t they be doing that getting ON??? And they wonder why so many people are mad at them.

We realize that this will fall on deaf ears at the TSA, but it’s worth pointing out that there’s this old Constitutional amendment that was designed to protect the American people from this exact type of violation of personal liberty:

An undercover TSA agent was able to get through security at Dallas/Fort Worth International Airport with a handgun during testing of the enhanced-imaging body scanners, according to a high-ranking, inside source at the Transportation Security Administration.

The source said the undercover agent carried a pistol in her undergarments when she put the body scanners to the test. The officer successfully made it through the airport’s body scanners every time she tried, the source said.

“In this case, where they had a test, and it was just a dismal failure as I’m told,” said Larry Wansley, former head of security at American Airlines. “As I’ve heard (it), you got a problem, especially with a fire arm.”

Wansley said covert testing by the TSA is commonplace — although failing should be rare.

The TSA insider who blew the whistle on the test also said that none of the TSA agents who failed to spot the gun on the scanned image were disciplined. The source said the agents continue to work the body scanners today.

I contend that this story is just the tip of the iceberg into the US government’s black operations to further the Patriot Act, funding for Homeland Security and the TSA, and to keep intensity up for the so called War on Terror.

Respected lawyer and community leader, Kurt Haskell, has nothing to gain from pointing his finger at the federal government.

He witnessed the underwear bomber, Umar Farouk Abdulmutallab, being whisked past security and led onto NorthWest Airlines flight 253, by a well-dressed man with an American accent- all without the passenger’s proper visa and passport documentation.

What the news piece doesn’t mention is that the State Dept did indeed put Mutallab on the plane, at the behest of “an unnamed US intelligence agency.”

Jesse Ventura Sues TSA in Pat-Down Smackdown:

In a complaint filed Monday morning in the U.S. District Court for Minnesota, Ventura is suing the U.S. Department of Homeland Security (DHS) and its secretary, Janet Napolitano, as well as the Transportation Security Administration (TSA), and its administrator, John Pistole.

Ventura accuses the agencies of violating his “basic rights to privacy and dignity, and his right to be free from unreasonable searches and seizures,” after he received a pat-down by a TSA agent at the Minneapolis-St. Paul International Airport in November 2010.

Ventura, who said he has a titanium implant after hip replacement surgery in 2008, alleges the pat-down included “warrantless, non-suspicion-based offensive touching, gripping and rubbing of the genital and other sensitive areas of his body,” which, the lawsuit contends, met “the definition for an unlawful sexual assault.”

Ventura’s Minneapolis-based attorney, David Olsen, told 5 EYEWITNESS NEWS this afternoon, “The security procedures are going too far. There’s a line somewhere and he believes that line has been crossed.”

Olsen said Ventura no longer flies on commercial aviation because he is unwilling to submit to either a pat-down or a full-body scan, putting his job as host of cable television’s Conspiracy Theory show, in jeopardy.

“He’s made a decision that someone needs to make a stand and he’s not one to back down from a fight,” said Olsen. “He sees the erosion of civil liberties here and he’s willing to stand up not only for himself, but for others.”

MINNEAPOLIS – Former Minnesota Gov. Jesse Ventura sued the Department of Homeland Security and the Transportation Security Administration on Monday, alleging full-body scans and pat-downs at airport checkpoints violate his right to be free from unreasonable searches and seizures.

Ventura is asking a federal judge in Minnesota to issue an injunction ordering officials to stop subjecting him to “warrantless and suspicionless” scans and body searches.

The lawsuit, which also names Homeland Security Secretary Janet Napolitano and TSA Administrator John Pistole as defendants, argues the searches are “unwarranted and unreasonable intrusions on Governor Ventura’s personal privacy and dignity . and are a justifiable cause for him to be concerned for his personal health and well-being.”

According to the lawsuit, Ventura received a hip replacement in 2008, and since then, his titanium implant has set off metal detectors at airport security checkpoints. The lawsuit said that prior to last November officials had used a non-invasive hand-held wand to scan his body as a secondary security measure.

But when Ventura set off the metal detector in November, he was instead subjected to a body pat-down and was not given the option of a scan with a hand-held wand or an exemption for being a frequent traveler, the lawsuit said.

The lawsuit said the pat-down “exposed him to humiliation and degradation through unwanted touching, gripping and rubbing of the intimate areas of his body.”

It claims that under TSA’s policy, Ventura will be required to either go through a full-body scanner or submit to a pat-down every time he travels because he will always set off the metal detector.

Ventura, who was Minnesota governor from 1999 through 2002 and is now the host of the television program “Conspiracy Theory,” did not immediately return a phone message seeking comment.

The holiday brought bittersweet news: unless the Transportation Security Authority disbands, I’ll never see a certain friend of mine again. His long-term unemployment finally ended, and next month, he starts a great new job. But it’s in Texas, too far to drive; from my place in Connecticut to his new home in San Antonio is 2,000 miles – 500 more than separates London from Moscow.

As an American – that is, someone considered lucky to get seven consecutive days off work – the only way I could possibly travel such distance is to fly. But flying includes the legal obligation I submit to having my genitalia groped by some TSA thug wearing the same latex gloves already shoved down nine dozen other strangers’ underwear. There’s only two ways an American flyer can reliably avoid this: be rich enough to buy your own plane, or a high-ranking congressman or other VIP exempt from the indignities they inflict upon ordinary citizens.

The ACLU maintains an ever-growing database of these indignities, many so graphic they’re illegal to broadcast over public airwaves. Actions that violate FCC standards are embraced by the TSA. “Mary in Texas” reported:

The TSA agent used her hands to feel under and between my breasts. She then rammed her hand up into my crotch until it jammed into my pubic bone … I was touched in the pubic region in between my labia … She then moved her hand across my pubic region and down the inner part of my upper thigh to the floor. She repeated this procedure on the other side. I was shocked and broke into tears.

A woman named Chris said:

“In the four times she explored the area where my inner thigh met my crotch, she touched my labia each time, and one pass made contact with my clitoris, through two layers of clothing. I told her I felt humiliated, assaulted and abused … In my work as a nurse, if I did what the TSA did against a patient’s will it would be considered assault and battery, and I did not see how the TSA should have different rules.”

Recipients of such treatment aren’t allowed to show distress. Melissa from Massachusetts did anyway:

“I was shaking and crying the entire time. I was begging them to hurry up but they kept stopping and telling me to calm down. It is impossible to gain composure when a stranger has her hands in your underwear.”

I couldn’t. I know my limits: can’t sprout wings and fly, spin straw into gold, or ooze obedience toward anyone who’d treat me as the TSA treats Melissa, Mary, Chris and countless others. And once I said something rude – even an obscenity-free comment like “Have fun on your knees, sniffing my crotch like the dog that you are” [see top photo] – I’d be arrested on terrorism charges and the media would run sympathetic stories about poor TSA agents disliked for merely following orders. Self-described patriots would say “Disrespecting authority is unAmerican” and recommend harsh punishment for me.

This is not the first time we have been trolled by individuals connected to the TSA. Someone posted a personal attack on me from an IP belonging to mitre.org, a corporation whose core competency is securing federal government contracts, including DHS and TSA ones. Any effective TSA resistance threatens not only the TSA itself but also the bureaucrats who got us to this point and the corporations who are getting paid for the technology.

While the application of scientific knowledge creates technology, sometimes the technology is later redefined by science. Such is the case with terahertz (THz) radiation, the energy waves that drive the technology of the TSA: back scatter airport scanners.

Emerging THz technological applications

THz waves are found between microwaves and infrared on the electromagnetic spectrum. This type of radiation was chosen for security devices because it can penetrate matter such as clothing, wood, paper and other porous material that’s non-conducting.

This type of radiation seems less threatening because it doesn’t penetrate deeply into the body and is believed to be harmless to both people and animals.

THz waves may have applications beyond security devices. Research has been done to determine the feasibility of using the radiation to detect tumors underneath the skin and for analyzing the chemical properties of various materials and compounds. The potential marketplace for THz driven technological applications may generate many billions of dollars in revenue.

Because of the potential profits, intense research on THz waves and applications has mushroomed over the last decade.

Health risks

The past several years the possible health risks from cumulative exposure to THz waves was mostly dismissed. Experts pointed to THz photons and explained that they are not strong enough to ionize atoms or molecules; nor are they able to break the chains of chemical bonds. They assert—and it is true—that while higher energy photons like ultraviolet rays and X-rays are harmful, the lower energy ones like terahertz waves are basically harmless. [Softpedia.com]

While that is true, there are other biophysics at work. Some studies have shown that THZ can cause great genetic harm, while other similar studies have shown no such evidence of deleterious affects.

Boian Alexandrov at the Center for Nonlinear Studies at Los Alamos National Laboratory in New Mexico recently published an abstract with colleagues, “DNA Breathing Dynamics in the Presence of a Terahertz Field” that reveals very disturbing—even shocking—evidence that the THz waves generated by TSA scanners is significantly damaging the DNA of the people being directed through the machines, and the TSA workers that are in close proximity to the scanners throughout their workday.

From the abstracts own synopsis:

“We consider the influence of a terahertz field on the breathing dynamics of double-stranded DNA. We model the spontaneous formation of spatially localized openings of a damped and driven DNA chain, and find that linear instabilities lead to dynamic dimerization, while true local strand separations require a threshold amplitude mechanism. Based on our results we argue that a specific terahertz radiation exposure may significantly affect the natural dynamics of DNA, and thereby influence intricate molecular processes involved in gene expression and DNA replication.”

In layman’s terms what Alexandrov and his team discovered is that the resonant effects of the THz waves bombarding humans unzips the double-stranded DNA molecule. This ripping apart of the twisted chain of DNA creates bubbles between the genes that can interfere with the processes of life itself: normal DNA replication and critical gene expression.

Other studies have not discovered this deadly effect on the DNA because the research only investigated ordinary resonant effects.
