ICE Agents Sue Homeland Security To Stop Obama’s Deferred Deportation Policy

ICE Agents Sue to Stop Obama’s Deferred Deportation Policy (FOX News, Aug 23, 2012):

Disgruntled Immigration and Customs Enforcement agents are suing their bosses over changes made to deportation policy by President Barack Obama.

A lawsuit filed Thursday on behalf of 10 ICE agents against the head of the Department of Homeland Security, Janet Napolitano, and ICE Director John Morton asks the courts to overturn the June 15 directive by Obama to suspend deportation proceedings and offer work authorization to some immigrants brought here illegally as children.

The ICE agents accuse the Obama administration of keeping them from enforcing immigration law, and of overstepping Congress by changing deportation policy through a directive rather than legislation.

“The Directive commands ICE officers to violate federal law,” the lawsuit says.

Obama Regime Ends States Right To Enforce Immigration Laws

Obama Administration Ends States Right to Enforce Immigration Laws, ICE Mostly Won’t Respond (Intel Hub, June 25, 2012):

On the same day that a Supreme Court ruling stroke down key provisions of the controversial Arizona immigration law, President Obama has ended a federal program that allowed state and local police to deputize officers in order to make federal immigration arrests.

With a stroke of his pen Obama has effectively ended state immigration enforcement, forcing states to now call upon the infamous Department of Homeland Security’s Immigrations and Custom Enforcement (ICE) wing in order to deport ANY illegal.

High court strikes down key parts of Arizona immigration law (NBC Politics, June 25, 2012):

Updated at 1:15 am ET In a split decision, the Supreme Court on Monday upheld one part of a tough Arizona immigration law, but struck down other sections.

The part of the law the justices upheld requires police officers stopping someone to make efforts to verify the person’s immigration status with the federal government.

Text of the decision (PDF)

The justices struck down three other parts of the law:

  • One making it a crime for an illegal immigrant to work or to seek work in Arizona;
  • One which authorized state and local officers to arrest people without a warrant if the officers have probable cause to believe a person is an illegal immigrant;
  • And one that made it a state requirement for immigrants to register with the federal government.

“Arizona may have understandable frustrations with the problems caused by illegal immigration” while the federal goverrment tries to enforce immigration law, but the state “may not pursue policies that undermine federal law,” wrote Justice Anthony Kennedy in the majority opinion.

Judge Napolitano on New Immigration Policy: ‘Obama Bypassing Congress For Umpteenth Time’ (= Totally Unconstitutional) – (Video)

YouTube Added: 19.06.2012

Description:

Judge Andrew Napolitano stopped by Fox & Friends Tuesday morning to discuss President Barack Obama’s route to enacting his new immigration policy and what impact it might have for deportations in the future.

“The problem is this,” Napolitano told host Brian Kilmeade, “the President has unilaterally changed the law. He has rewritten the law. His heart may be in the right place for a group of people that he feels will have to stay here, but he can’t do that. Only Congress can change the law. The law requires predictability. It requires fairness and it has to be constitutional. If the President writes it, it’s not constitutional, and if he changes the law, there’s no predictability and only the Congress can decide whether coming before age 16 is fair. How about 15? How about 17? The President made it out of his own head and we don’t have a system that permits that.”

“If the President thinks a law is unconstitutional, he cannot enforce — he can refuse to enforce it,” he continued. “Thomas Jefferson did that. But the President cannot rewrite a law to make it more to his liking. Only the Congress can remedy that. The President is bypassing the Congress yet again for what seems to be the umpteenth time.”

Citizenship for sale: Foreign investors flock to U.S. (CNN Money):

NEW YORK (CNNMoney) — Good riddance, Eduardo.

Facebook co-founder Eduardo Saverin drew public ire last month following the revelation that he had renounced his U.S. citizenship, a move widely seen as a tax dodge. But thousands of wealthy foreigners are lining up to replace him, making investments here and putting themselves on a path to citizenship in the process.

The State Department expects to issue over 6,000 “investor visas” in the current fiscal year, which would be an all-time record. Other countries, meanwhile, are following the U.S.’s lead, keen to spur growth in lean economic times.

Stolen Babies? Immigrant Mother Loses Four Kids (ABC News, Feb. 2, 2012):

The scars of childbirth were still healing on Amelia Reyes Jimenez’s stomach in 2008 when police came to her Phoenix apartment and took her three-month-old daughter from her arms.

Three and a half years later, Reyes Jimenez and her four children have become statistics in the U.S. crackdown on illegal immigration. Each year thousands of children of undocumented immigrants, like Amelia’s kids, wind up in foster care when their parents are arrested for immigration violations. Some are even adopted by U.S. citizens while their parents are held in federal detention centers or deported back to their native countries.

Reyes Jimenez’s son and three daughters are now living in foster care in Phoenix, and are awaiting possible adoption. Reyes Jimenez is back in Mexico, her parental rights terminated by an Arizona judge, and she cries when she remembers the raid that began it all.

“My daughters were calling, ‘Mommy, my Mommy,'” said Reyes Jimenez. “I felt destroyed. I felt like I would never see my girls, even worse [the baby] was so small. I had just bought her cradle and her stroller.”

A new study by the human rights group Applied Research Center estimates that as of summer 2011 there were at least 5,100 children of detained immigrants in foster care in 22 states.

ICE HQ Ordered Agents Not to Arrest Illegals–Including Fugitives

Union President Testifies: ICE HQ Ordered Agents Not to Arrest Illegals–Including Fugitives (CNS News, Oct. 20, 2011):

Chris Crane, president of a union that represents Immigration and Customs Enforcement officers, testified in the House Judiciary Subcommittee on Immigration last week that ICE agents have been told by ICE headquarters not to arrest illegal aliens who do not have a prior criminal conviction even if they are fugitives who have been ordered deported by an immigration judge or are individuals who have illegally re-entered the United States after being deported and thus have perpetrated a felony.

“Aliens who could not be arrested included but were not limited to ICE fugitives that had been ordered deported by a federal immigration judge as well as aliens who had illegally re-entered the United States after deportation, a federal felony,” Crane, who is also an active-duty ICE agent, told the committee on Oct. 12.

“ICE officers and agents also alleged that they were not permitted to arrest or even speak to confirmed or suspected illegal aliens encountered in the field during operations and were prohibited from running standard criminal record checks for wants and warrants,” Crane testified.

Dictator Obama Prepares For Conflict With American Citizens (ALIPAC)

For your information …

Dictator Obama Prepares for Conflict With American Citizens (ALIPAC, August 25, 2011):

This week several left wing illegal alien Amnesty supporting organizations and blogs are lying to their readers claiming that I suggested or called for violent and illegal insurgency to remove Barack Obama from office while appearing on the Janet Mefferd radio show this past Monday.

I made no such comments. In fact, while I was reporting the condition that the American public is being forced into by Dictator Barack Obama, I said that I could not even talk about such things. Here is the quote that has Obama supporters eager to malign my meaning.

“We’re no longer referring to him as President Barack Obama, our national organization has made the decision and made the announcement we now refer to him as Dictator Barack Obama. That’s what he is. And basically at this point, if you’re looking for a peaceful political recourse, there really isn’t one that we can think of, and I’m really not sure what to tell people out there other than I guess they need to make decisions soon to just accept whatever comes next or some type of extra-political activities that I can’t really talk about because they’re all illegal and violent.”

Listen to Entire William Gheen Interview on Janet Mefferd Show (CLICK HERE)

My contention that Barack Obama has committed a form of Treason against the people of the United States has his elite political supporters bouncing off the walls. Obama’s approval numbers are crashing as more Americans find out about Obama’s illegal Amnesty and dictatorial actions, and my musings on a talk radio show are now drawing more attention to what has happened.

No major media outlets in America are adequately conveying to the public what has just happened here, so my baiting of Obama supporters on the Mefford show is helping to generate some controversy that escalates exposure of Obama’s dastardly actions to support illegal aliens with Amnesty while silencing the political voices of all Americans that oppose such matters.

Today our national organization Americans for Legal Immigration PAC (ALIPAC) has taken the difficult step of publicly calling on Congress to impeach or use any means at their disposal to stop President Obama and remove him from the Executive Branch of the US Government as soon as possible…

We are calling on Americans of every race, political party, and walk of life to unite behind this call for the impeachment of President Obama. All Americans who believe in the US Constitution, laws of Congress, and self-governance of Americans through elections should stand up against the recent authoritarian and unjust actions of President Obama.

Arizona May Require Hospitals to Check Citizenship

PHOENIX (AP) — Arizona lawmakers are trying to widen the state’s illegal immigration crackdown with a proposal to require hospitals to confirm whether patients are in the country legally.

The National Conference of State Legislatures says it knows of no other states considering similar bills.

The proposal being heard late Monday by the Arizona Senate’s judiciary committee would require hospitals to contact immigration authorities if a patient is an illegal immigrant.

Dream Amnesty Allows Obama To Grant Amnesty To All Illegals – Dream Act Amnesty Defeated Again Today!

Update:

ALIPAC Press Release Angers Dream Amnesty Sponsor (ALIPAC):

For National Release

December 21, 2010

CONTACT: Americans For Legal Immigration PAC (ALIPAC)
(866) 703-0864 [email protected]

Americans for Legal Immigration PAC is releasing a statement today rebutting Senator Dick Durbin’s (D-IL) attacks on the group’s statements that helped defeat the Dream Act Amnesty cloture vote this past Saturday December 18, 2010, which marks the legislation’s seventh defeat in Washington.

Senator Durbin scrambled to save the bill from ALIPAC’s accusation that the waiver provision found on page 5, line 21, would allow the Obama administration to bypass most of the requirements in the bill and give amnesty to most illegal aliens in America including terrorists and criminals.

In a desperate effort to save the bill from ALIPAC’s revelations about the waiver, Senator Durbin claimed on the Senate floor that, “During the course of preparing for this, one Senator received a notice that said that the DREAM Act allows the Secretary of Homeland Security to waive all grounds of inadmissibility for illegal aliens including criminals, terrorists, and certain gang members. We had my staff call the Senator’s office who put this out and ask: Where did you get that? That is not what it says. They couldn’t point to any source.”

He continues, “We then called the Department of Homeland Security and said: “All right, give us an answer. Under the DREAM Act, could you waive all these things, would terrorists and criminals have a right? Of course not. The Department of Homeland Security came back and said: No, that isn’t what the law says at all. So we are battling not only passing a bill but a lot of misinformation. That is troublesome.”

The source of this bill stopping information is no mystery. The source is the text of the legislation itself and the national press release put out by Americans for Legal Immigration PAC at 9:00 am on the same day of Durbin’s comments titled ‘Dream Amnesty Allows Obama To Grant Amnesty To All Illegals’

Senator Durbin is likely aware of the source of his concerns about the waiver provision because some of his staff members subscribe to ALIPAC’s email alerts and updates!

All US Senate offices were flooded with copies of this press release including calls from thousands of activists.

“Senator Durbin’s attempt to use Homeland Security, which under Napolitano is one of the most aggressive promoters of Amnesty for illegal immigrants, is absurd,” said William Gheen President of ALIPAC. “All we did is draw lawmakers attention to page 5 line 21 of HR 5281 where it clearly states that Homeland Security can waive all of the other requirements in the bill and apply this legislation as mass amnesty for most of the illegal aliens in America!”

ALIPAC, which has played a key role in defeating the Dream Act Amnesty seven times following this recent vote, stands by the decision to release the waiver information as a method to stop HR 5281. If more elected officials actually read the bills they were voting on, such efforts would not be needed.

Close inspection of HR 5281, which was defeated in the Senate by a narrow margin, finds a blanket waiver provision on page 5 line 21 Sec. 6 (a)(2). Immediately following all of the promises in the bill that only illegal aliens who claim they are under 30, claim they have been in the US 5 years, and claim they were brought here by others when they were under 16, and claim they are going to college or into the military, the waiver allows all of these considerations to be dropped.

“(2) WAIVER.—With respect to any benefit under this section and sections…the Secretary of Homeland Security may waive the… ground of inadmissibility …and the ground of deportability… for humanitarian purposes or family unity or when it is otherwise in the public interest.”

“We are glad that our organization’s decision to focus on this dirty trick waiver buried in the bill upset Senator Durbin so much,” said William Gheen. “Next time we want him to cite the obvious source of his problem. We are Americans of every race, party, and walk of life who oppose illegal immigration and Amnesty. We are Americans for Legal Immigration PAC!”

Dream Act Amnesty Defeated Again Today!

Friends of ALIPAC,

We have won another round against Reid, Pelosi, and Obama’s Dream Act Amnesty!

The Cloture Vote on HR 5281, which passed the House by a narrow margin, has failed with 55 votes for Cloture and 41 against leaving the bill supporters 5 votes short of what they needed.

We want thank each and every one of you that has supported ALIPAC, or NumbersUSA, or the many other great organization leading the charge against this nationally destructive Amnesty.

Your calls, donations, and emails have made the difference and you did it without significant mass media support from the major networks including Drudge Report which took a dive and kept silent on this issue again.

We appreciate all of the sacrifices people have made and those working today instead of spending much deserved time with their friends and family members.

While Dream Amnesty Cloture has failed we are not out of the woods just yet until the final bell rings and Congress adjourns for the session. In fact, we will not be truly safe until January 6, when the new historic Congress you helped to elect is sworn in.

We must remain diligent and ready to respond at a moments notice through Christmas and New Years as evil Harry Reid and his traitors could try anything at any moment.

But today, for this brief moment, our hard work has paid off.

Three cheers for our victory over Dream Amnesty!

Praise be to God for allowing us to still have a country today.

Sincerely,

William Gheen and The ALIPAC Team

Dream Amnesty Allows Obama To Grant Amnesty To All Illegals

ALIPAC is rallying talk radio show listeners and American citizens to call the US Senate to oppose the Dream Act Amnesty today. The bill contains a waiver that would allow the Secretary of Homeland Security and President Obama to grant Amnesty to most illegal immigrants in America.

“The Dream Act Amnesty is a Nightmare already and would displace several million innocent American students, workers, and voters,” said William Gheen, President of ALIPAC. “But now we find a waiver on page 5, line 21 of HR 5281 that allows Obama to grant Amnesty for most of the 12-20 million illegal aliens in America!”

Close inspection of HR 5281, which passed the house last week by a narrow margin, finds a blanket waiver provision on page 5 line 21 Sec. 6 (a)(2). Immediately following all of the promises in the bill that only illegal aliens that claim they are under 30, claim they have been in the US 5 years, and claim they were brought here by others when they were under 16, and claim they are going to college or into the military, the waiver allows all of these considerations to be dropped.

“(2) WAIVER.—With respect to any benefit under this section and sections…the Secretary of Homeland Security may waive the… ground of inadmissibility …and the ground of deportability… for humanitarian purposes or family unity or when it is otherwise in the public interest.”

This provision will grant the Obama administration the power to declare full amnesty for the 12 to 20 million adult illegal immigrants in America!

“Most of America has been suckered into thinking this Dream Act Amnesty cloture vote will just be about a subsection of illegal aliens brought here as kids and that’s a lie,” said William Gheen. “Americans need to call the Senate today to oppose this bill because it gives the Obama administration the power to grant Amnesty to tens of millions of illegals who will in turn destroy the borders of the United States.”

Armed EU guards to patrol Greece-Turkey border to stem steeply increasing illegal immigration

A new force of armed European guards is to be dispatched to Greece to patrol the country’s border with Turkey in an attempt to stem steeply increasing illegal immigration into Europe.

The deployment of the Rapid Intervention Border Teams, assembled from the border guard forces of other European countries, will be the first time Brussels has deployed multinational armed units on the EU’s external land border.

The teams are to arrive in Greece within days, the European commission announced today , although the precise numbers and makeup are yet to be decided.

A commission official said: “This is a new front. The teams are armed, but they can only use their arms in self-defence.”

Struggling to cope with the hundreds of migrants who are entering Greece every day through an inhospitable, unmonitored stretch of the country’s border with Turkey near the town of Edirne, Athens appealed to Brussels for help at the weekend.

“The flows of people crossing the border irregularly have reached alarming proportions,” said Cecilia Malmström, commissioner for home affairs. “Greece is manifestly not able to face this situation alone.”

Some eight out of 10 migrants entering Europe this year have arrived in Greece via Turkey, according to Brussels. Some are illegal economic migrants, at the mercy of gangs of human traffickers; many are Iraqi and Afghan asylum seekers, whose treatment by the Greek authorities the United Nations and the EU regard as indefensible.

Signs in Arizona warn of smuggler dangers

Drivers advised to travel north

texas-born-kingpin-edgar-la-barbie-valdez
ASSOCIATED PRESS Federal police stand guard by Texas-born kingpin Edgar ASSOCIATED PRESS Federal police stand guard by Texas-born kingpin Edgar “La Barbie” Valdez during his presentation to the press in Mexico City on Tuesday. Valdez, who was captured on Monday by federal police, faces drug-trafficking charges in the U.S. and has been blamed for a vicious turf war that has included bodies hung from bridges and shootouts in central Mexico.

The federal government has posted signs along a major interstate highway in Arizona, more than 100 miles north of the U.S.-Mexico border, warning travelers the area is unsafe because of drug and alien smugglers, and a local sheriff says Mexican drug cartels now control some parts of the state.

The signs were posted by the Bureau of Land Management (BLM) along a 60-mile stretch of Interstate 8 between Casa Grande and Gila Bend, a major east-west corridor linking Tucson and Phoenix with San Diego.

They warn travelers that they are entering an “active drug and human smuggling area” and they may encounter “armed criminals and smuggling vehicles traveling at high rates of speed.” Beginning less than 50 miles south of Phoenix, the signs encourage travelers to “use public lands north of Interstate 8” and to call 911 if they “see suspicious activity.”

Pinal County Sheriff Paul Babeu, whose county lies at the center of major drug and alien smuggling routes to Phoenix and cities east and west, attests to the violence. He said his deputies are outmanned and outgunned by drug traffickers in the rough-hewn desert stretches of his own county.

“Mexican drug cartels literally do control parts of Arizona,” he said. “They literally have scouts on the high points in the mountains and in the hills and they literally control movement. They have radios, they have optics, they have night-vision goggles as good as anything law enforcement has.

“This is going on here in Arizona,” he said. “This is 70 to 80 miles from the border – 30 miles from the fifth-largest city in the United States.”

He said he asked the Obama administration for 3,000 National Guard soldiers to patrol the border, but what he got were 15 signs.

Arizona Gov. Jan Brewer condemned what she called the federal government’s “continued failure to secure our international border,” saying the lack of security has resulted in important natural recreational areas in her state being declared too dangerous to visit.

In a recent campaign video posted to YouTube, Mrs. Brewer – standing in front of one of the BLM signs – attacked the administration over the signs, calling them “an outrage” and telling President Obama to “Do your job. Secure our borders.”

Arizona Governor Jan Brewer Slams President Obama: Warning Signs Are Not Enough

BLM spokesman Dennis Godfrey in Arizona said agency officials were surprised by the reaction the signs generated when they were put up this summer.

PHOENIX (Reuters) – The U.S. government will have unmanned surveillance aircraft monitoring the whole southwest border with Mexico from September 1, as it ramps up border security in this election year, a top official said on Monday.

Homeland Security Secretary Janet Napolitano said U.S. Customs and Border Protection would begin flying a Predator B drone out of Corpus Christi, Texas, on Wednesday, extending the reach of the agency’s unmanned surveillance aircraft across the length of the nearly 2,000 mile border with Mexico.

“With the deployment of the Predator in Texas, we will now be able to cover the southwest border from the El Centro sector in California all the way to the Gulf of Mexico in Texas, providing critical aerial surveillance assistance to personnel on the ground,” Napolitano said during a conference call.

“This is yet another critical step we have taken in ensuring the safety of the border and is an important tool in our security toolbox,” she added.

Study: Illegal Immigrants Account for 8% of US Newborns

As many as 340,000 of the 4.3 million babies born in the U.S. in 2008 had at least one parent who was an illegal immigrant, according to a Pew Hispanic Center study of Census Bureau data.

Unauthorized immigrants, who make up a little more than 4 percent of the population, are for the most part young and have high birth rates, according to the Pew study. Their children make up 8 percent of the newborn population and 7 percent of those under 18.

Senator Lindsey Graham, a South Carolina Republican, is leading an effort to change the 14th Amendment to the U.S. Constitution, which guarantees U.S. citizenship to anyone born in the country.

“We just can’t have people swimming across the river having children here,” he told Fox News.

The study from the Washington-based Pew center said 79 percent of the 5.1 million children under age 18 of illegal immigrants were born in the U.S. and therefore are citizens.

Because some of these children have one parent who is a legal resident, the Pew study doesn’t bolster the argument to change the 14th amendment, said the Immigration Policy Center, a Washington-based organization that opposes Graham’s initiative.

A June poll by the Pew Research Center for the People & the Press found that 56 percent of Americans oppose changing the 14th amendment and 41 percent want to change it.

Florida Attorney General Bill McCollum: Florida legislation goes ‘one step further’ than Arizona immigration law

Florida Attorney General proposes tougher illegal immigrant curbs

florida-attorney-general-bill-mccollum

ORLANDO (Reuters) – Florida Attorney General Bill McCollum on Wednesday proposed tougher curbs against illegal migrants in his melting-pot state which he said would go “one step further” than a similar contested Arizona law.

The proposal by McCollum, who is lagging in a race to become the Republican candidate for governor, was certain to thrust Florida into the heated immigration debate that is a major issue ahead of November 2 midterm Congressional elections.

“This legislation will provide new enforcement tools for protecting our citizens and will help our state fight the ongoing problem created by illegal immigration,” McCollum said, presenting the proposed measures at an event in Orlando.

“Florida will not be a sanctuary state for illegal aliens,” added McCollum, accompanied by Representative Will Snyder.

The legislation will require Florida law enforcement officials to check a suspected illegal immigrant’s status in the course of a stop, or a violation of another law. This goes beyond the existing situation in the state where officers are allowed to check immigration status, but not required to.

(CNSNews.com) – Pinal County (Ariz.) Sheriff Paul Babeu is hopping mad at the federal government.

Babeu told CNSNews.com that rather than help law enforcement in Arizona stop the hundreds of thousands of people who come into the United States illegally, the federal government is targeting the state and its law enforcement personnel.

“What’s very troubling is the fact that at a time when we in law enforcement and our state need help from the federal government, instead of sending help they put up billboard-size signs warning our citizens to stay out of the desert in my county because of dangerous drug and human smuggling and weapons and bandits and all these other things and then, behind that, they drag us into court with the ACLU,” Babeu said.

The sheriff was referring to the law suits filed by the American Civil Liberties Union and the U.S. Department of Justice challenging the state’s new immigration law.

“So who has partnered with the ACLU?” Babeu said in a telephone interview with CNSNews.com. “It’s the president and (Attorney General) Eric Holder himself. And that’s simply outrageous.”

Last week, U.S. District Judge Susan Bolton placed a temporary injunction on portions of the bill that allowed law enforcement personnel during the course of a criminal investigation who have probable cause to think an individual is in the country illegally to check immigration status. The state of Arizona filed an appeal on Thursday with the 9th Circuit Court of Appeals.

“Our own government has become our enemy and is taking us to court at a time when we need help,” Babeu said.

Arizona is preparing an appeal of immigration ruling

PHOENIX (AP) – Arizona is preparing to ask an appeals court to lift a judge’s ruling that put most of the state’s immigration law on hold in a key first-round victory for the federal government in a fight that may go to the U.S. Supreme Court.

Gov. Jan Brewer called Wednesday’s decision by U.S. District Judge Susan Bolton “a bump in the road” and vowed to appeal.

Protesters in Phoenix went ahead with plans Thursday for a march to the state Capitol and a sit-in at the office of Sheriff Joe Arpaio. The sheriff said if protestors were disruptive, they’d be arrested, and he vowed to go ahead with a crime sweep targeting illegal immigrants.

About 1,200 soldiers from the US National Guard are to be deployed along the border with Mexico from 1 August to try to tackle the twin problems of illegal immigration and drug-smuggling.

About half of the troops are to be sent to Arizona, which is at the centre of the national debate over illegal immigration. The state is planning to introduce a law next week to crack down on people entering unlawfully.

There is a 30ft steel fence running along much of the US border, including the section that runs through Arizona, but much of the area is so remote that those crossing illegally can easily put up ladders and climb over. Drug cartels are even more brazen, occasionally ramming the fence in heavily armoured jeeps.
