Federal Judge Rules In Favor Of Transocean And BP: The Fact That The Oil Flow Has Stopped Makes Those Lawsuits Irrelevant

BP Wins a Big One in Oil Spill Litigation (Courthouse News Service, Friday, June 17, 2011):

NEW ORLEANS (CN) – Ruling in favor of Transocean and BP, a federal judge on Thursday dismissed third-party environmental claims in a giant pleading bundle in the Deepwater Horizon oil spill litigation, saying the fact that the oil flow has stopped makes those lawsuits irrelevant.

“The injunction at this stage would be useless, as not only is there no ongoing release from the well, but there is also no viable offshore facility from which any release could possibly occur,” U.S. District Judge Carl Barbier wrote. “The Macondo well is dead, and what remains of the Deepwater Horizon vessel is on the ocean floor, where it capsized and sank in 5,000 feet of water.

“Moreover, BP and the agencies comprising the Unified Area Command have been and are cleaning up the Gulf of Mexico. An injury is not redressable by a citizen suit when the injury is already being addressed.”
Judge Barbier is overseeing the massive, consolidated oil spill litigation, which has been divided into “bundles,” based upon the nature of the claims.

In instances where claims in the D1 bundle pertain to how the oil is being cleaned up, Barbier ruled that even if he allowed those claims to go forward, the claimants are not directly involved in the cleanup, so a ruling in their favor would not affect how the cleanup is progressing.

Libyan leader Moamar Gadhafi turned down a chance to invest with Bernie Madoff and accused ponzi schemer Allen Stanford, according to a new diplomatic cable released by WikiLeaks. (The U.K.’s Telegraph has the full cable, dated January 28, 2010.)

In the cable, the head of the Libyan sovereign wealth fund, Mohamed Layas, claimed to control $32 billion in liquid assets, most of which was deposited at U.S. banks. Layas, according to the cable, was miffed at Libyan funds that were “mismanaged” by Lehman Brothers, the failed investment bank.

“Layas denied press reports that the LIA had invested USD 100 million with the infamous Allen Stanford. He said that he had personally written a letter to the “Financial Times” disputing the information, explaining that Stanford had approached the LIA in the middle of his crisis, offering a 7-8% share in his investment scheme, but Layas had refused. Layas also mentioned having been previously approached by Bernard Madoff about an investment opportunity, “but we did not accept.” On the contrary, LIA’s recent purchase of the Canadian Verenex oil company — after much controversy over the manner in which it was purchased and share price — was considered by Layas a “good deal.” LIA plans to operate Verenex jointly with the Libyan Investment and Development Corporation (LIDCO).

(New York Times) LONDON — Global oil companies said Monday that they were making plans to evacuate employees in Libya after some operations there were disrupted by political unrest. Libya holds the largest crude oil reserves in Africa, and the moves drove some stock prices down and a crucial oil benchmark to a three-year high.

The largest and most established foreign energy producer in Libya, Eni of Italy, said in a statement that it had begun repatriating “nonessential personnel” and the families of its employees.

The Norwegian energy company Statoil, which operates in Libya in partnership with Repsol of Spain and Total of France, said that it would close its office in Tripoli and that a handful of foreign workers were leaving. “The safety of our personnel is our main priority,” said a spokesman, Bard Glad Pedersen.

OMV of Austria, which produces about 34,000 barrels of oil a day in Libya, said it planned to evacuate 11 workers and their families, leaving only essential staff.

The Organization of the Petroleum Exporting Countries ranks Libya No.7 among its members, with 4.4 percent of OPEC’s proven crude oil reserves. Libya exports most of its oil to Europe, with Italy its biggest customer, according to the United States Energy Information Administration.

Shares in Eni and OMV dropped Monday, while the price of Brent crude, an important benchmark for oil traded in London, jumped $3.22 a barrel, or 3.2 percent, to settle at $105.74, before spiking above $108 in after-hours dealing. It was the highest level since 2008.

“We’re concerned, and of course we’d like to see a solution sooner rather than later,” said Jason Kenney, an analyst with ING Financial Markets. “It’s very difficult to see how this is going to go. The oil price will be volatile.”

The British oil company BP, which has only exploration operations in Libya, said it was planning to evacuate some of its 40 foreign workers, mostly from Tripoli, where the unrest spread Sunday. It also said it had suspended preparations for a drilling project because employees of a contractor had been evacuated.

Scientist Finds The Bottom of The Gulf of Mexico Still Oily And Dead

WASHINGTON (AP) — Oil from the BP spill remains stuck on the bottom of the Gulf of Mexico, according to a scientist’s video and slides that demonstrate the oil isn’t degrading as hoped and has decimated life on parts of the sea floor.

At a science conference in Washington, marine scientist Samantha Joye of the University of Georgia aired early results of her December submarine dives around the BP spill site. She went to places she had visited in the summer and expected the oil and residue from oil-munching microbes would be gone by then. It wasn’t.

“There’s some sort of a bottleneck we have yet to identify for why this stuff doesn’t seem to be degrading,” Joye told the American Association for the Advancement of Science annual conference in Washington. Her research and those of her colleagues contrasts with other studies that show a more optimistic outlook about the health of the gulf, saying microbes did great work munching the oil.

BP Accused By Oil-Spill Victims Of Racketeering Law Violation

Jan. 25 (Bloomberg) — BP Plc was accused by oil-spill victims’ lawyers of breaking civil racketeering law by engaging in acts that led to the worst such disaster in U.S. history.

“BP engaged in a pattern of fraudulent conduct directed at regulators from the inception of the Macondo project, continuing through and after the spill and to this day,” victims’ lawyers Stephen Herman and James Roy, said yesterday in a court filing in New Orleans. “BP’s fraudulent actions and omissions were part of a broader pattern of unlawful conduct that it has employed over the years to place profits over safety.”

Herman and Roy are liaison counsel for a committee representing plaintiffs in more than 400 lawsuits over personal and economic injuries caused by last April’s explosion of the Deepwater Horizon drilling rig off the Louisiana coast.

The rig, owned by a unit of Transocean Ltd., was drilling the well, named Macondo, for BP at the time of the blast. BP is the only company named as a defendant in the spill victims’ master civil complaint under the Racketeer Influenced and Corrupt Organizations Act, or RICO, originally aimed at organized crime.

Daren Beaudo, a BP spokesman, declined to comment on the filing.

Dear Mr. President;

The BP incident in the Gulf of Mexico has now been acknowledged as the greatest manmade disaster in history but there is yet another manmade disaster that must not be overlooked and has not been adequately addressed in the recently released report of the National Commission on the BP Deepwater Horizon oil disaster.

That second major disaster has been caused by the unnecessary use of the toxin Corexit dispersant. In early May of 2010 just after the crisis began, I requested that our Louisiana Attorney General Buddy Caldwell use whatever legal means were necessary to stop the use of this toxin. Shortly thereafter, Louisiana Governor Bobby Jindal requested that the use of this toxic dispersant be discontinued because of the long-term environmental damage. And still later, it was reported in the media that you also ordered BP to stop using Corexit. Surprisingly, I also read in the media that they even refused your request.

Mr. President, my concern is that this toxic and damaging chemical is still being used and it will compound the long-term damage to our state, our citizens, our eco-system, our economy, our seafood industry, our wildlife and our culture.

I am well aware that our emphasis, resources and energy is currently engaged working through the administrative and legal proceedings of the oil disaster but we must also recognize and begin the same process to address the damage Corexit has done and will continue to do as we go forward.

As the State Senator for District 1 in the southeastern corner of the State of Louisiana representing the parishes of St. Tammany, St. Bernard, Orleans and Plaquemines, I respectfully request that you have your administrative officials provide the information requested in this letter. I need to make that information available to my constituents who are seeing their lives and lands threatened and their way of life hanging in the balance. Due to the threats to public safety and ecological realities, I am compelled to write this letter requesting answers to my questions regarding the role of the United States Government in administering the response to the crises in the Gulf. It is apparent that the response directed by our government was inadequate because it allowed the use of Corexit dispersants which increased the toxicity level of the spilled oil and delivered no substantial benefit.

Corexit dispersants increased the toxicity of the oil itself when the two were mixed together. Its use caused the cross contamination of the Gulf water column by forcing the transfer of the surface oil downward through the water column, causing the oil to sink to the Gulf floor. The result was an unnecessary elevated negative impact as this same oil moved ashore later to the tidal zones delivering toxic weathered oil to coastal residents, tourists and businesses and workers in the Gulf region.

Government officials stated over and over that the use of the dispersants was designed to break up the oil into smaller digestible parts to be consumed by the sub-sea living micro-organisms. This strategy is unsubstantiated. In fact, the Corexit dispersant created the opposite results since Corexit contains toxic ingredients which act as biocides to prevent microbial digestion of the oil. Physical evidence supports that the entire response administered by government agencies have been inadequate.

Obama was the largest recipient of campaign donations from BP

Dec. 22 — BP and the government famously declared that most of the oil had disappeared.

But as I’ve noted, as much as 98% of the oil is still in the ocean.

I have repeatedly pointed out that BP and the government applied massive amounts of dispersant to the Gulf Oil Spill in an effort to sink and hide the oil. Many others said the same thing.

BP and the government denied this, of course.

But the oil is not remaining hidden.

Indeed, as the Wall Street Journal noted on December 9th:

A university scientist and the federal government say they have found persuasive evidence that oil from the massive Gulf of Mexico spill is settling on the ocean floor.

The new findings, from scientists at the University of South Florida and from a broad government effort, mark the latest indication that environmental damage from the blowout of a BP PLC well could be significant where it’s hardest to find: deep under the Gulf’s surface.

Scientists who have been on research cruises in the Gulf in recent days report finding layers of residue up to several centimeters thick from what they suspect is BP oil.

The material appears in spots across several thousand square miles of seafloor, they said. In many of those spots, they said, worms and other marine life that crawl along the sediment appear dead, though many organisms that can swim appear healthy.

Tests now have started to link some oil in the sediment to the BP well could add to the amount of money BP ends up paying to compensate for the spill’s damage.

The test results also raise questions about the possible downsides of the government’s use of chemical dispersants to fight the spill.

Under federal direction, about 1.8 million gallons of dispersants were sprayed on the spilled oil in an effort to break it up into tiny droplets that natural ocean microbes could eat up. At the time, officials said the dispersants shouldn’t cause oil from the spill to sink to the seafloor. However, more recently, a federal report said dispersants may have helped some spilled oil sink to the sediment.

Scientific teams have reported in recent months finding a strange substance on the Gulf floor, in some cases as far as about 80 miles from BP’s ill-fated Macondo well, which blew out in April and spilled an estimated 4.1 million barrels of oil into the Gulf before it was capped.

***”The chemical signatures are identical,” said Mr. Hollander, who found the contaminated samples in an area of the Gulf floor off the Florida Panhandle. Although it’s conceivable the tests could show a false match with the BP oil, “the statistical probability of something like that is unimaginable,” Mr. Hollander said.

The federal government also has found oil matching Macondo oil in Gulf sediment, Steve Murawski, a top National Oceanic and Atmospheric Administration scientist, said in an interview. He declined to disclose how much sediment contamination the government found, or exactly where in the Gulf it was, saying experts still are analyzing the test results.

***Samantha Joye, a University of Georgia oceanographer, also has found what she believes to be evidence of BP oil in Gulf sediment. She is awaiting lab results tracing the chemical fingerprints of sediment samples she took.

On a research cruise in the Gulf that ended Friday, she saw worms that crawl along the Gulf floor “just decimated,” she said. But eels and fish, which can swim away, often appeared fine, she said.

The Journal noted on December 18th:

Oil from BP PLC’s blown-out well has lodged in the sediment of the Gulf of Mexico at levels that may threaten marine life, according to a federal report released Friday.

BP oil spill incident commander dies in small plane crash

Jim Black, a BP incident commander for the company’s Gulf of Mexico oil spill response team, died in a small plane crash near Destin, Fla., on Tuesday night, the company confirmed.

“BP extends its heartfelt sorrow to the family of our friend and colleague, Jim Black, who, along with two other family members, died yesterday in a tragic plane crash,” BP America CEO Lamar McKay said in a statement.

“Jim was a devoted member of our Gulf Coast spill response team and served many years with Amoco and BP. He will be missed by all who knew him and worked with him. Jim and his family are in our thoughts and prayers.”

Victims of the Gulf of Mexico oil disaster won’t be able to sue BP or any of the other companies involved with the Deepwater Horizon rig if they accept a final payment from BP’s $20bn (£12.6bn) compensation fund.

The new rules are in a 12-page document posted on the website for the Gulf Coast Claims Facility.

The 90-day period in which the fund made emergency payments ended on Tuesday. But spill victims filing for these payments retained their legal right to sue BP.

Kenneth Feinberg, a Washington attorney overseeing the fund, said he had received 450,000 applications for emergency payments and that more than half had been filed within the past six weeks.

“That’s about four times what I thought they’d be,” he said. “It’s unheard of. Unprecedented. There’s never been anything like this in American history.”

However, he believes more than half of these claims will be rejected.

The oil spill commission set up by President Obama said it had “studied the hell out of this”.

The report will be embarrassing for Mr Obama who held BP responsible for the disaster, savaging its then chief executive Tony Hayward.

Following Mr Hayward’s complaint about the political and media pressure, Mr Obama said: “He wouldn’t be working for me after any of those statements.” The White House vowed to “keep our boot on the throat of BP”.

Mr Hayward has since stood down and been replaced by Bob Dudley.

At the time critics claimed that Mr Obama, who kept referring to BP as “British Petroleum”, was trying to shift the blame from American firms.

The spill which pumped 206 million gallons of oil into the Gulf of Mexico over five months was America’s worst environmental disaster.

Just three days after the U.S. Coast Guard admiral in charge of the BP oil spill cleanup declared little recoverable surface oil remained in the Gulf of Mexico, Louisiana fishers Friday found miles-long strings of weathered oil floating toward fragile marshes on the Mississippi River delta.

The discovery, which comes as millions of birds begin moving toward the region in the fall migration, gave ammunition to groups that have insisted the government has overstated clean-up progress, and could force reclosure of key fishing areas only recently reopened.

The oil was sighted in West Bay, which covers approximately 35 square miles of open water between Southwest Pass, the main shipping channel of the river, and Tiger Pass near Venice. Boat captains working the BP clean-up effort said they have been reporting large areas of surface oil off the delta for more than a week but have seen little response from BP or the Coast Guard, which is in charge of the clean-up. The captains said most of their sightings have occurred during stretches of calm weather, similar to what the area has experienced most of this week.

On Friday reports included accounts of strips of the heavily weathered orange oil that became a signature image of the spill during the summer. One captain said some strips were as much as 400 feet wide and a mile long.

The captains did not want to be named for fear of losing their clean-up jobs with BP.

The White House blocked government scientists from warning the American public of the potential environmental disaster caused by BP’s broken well in the Gulf of Mexico, a report released by the national commission investigating the oil spill said yesterday.

The report, produced by a panel appointed by Barack Obama to investigate the spill, said that about two weeks after the BP rig exploded scientists from the National Oceanic and Atmospheric Administration (NOAA) asked the White House for permission to release their models showing their worst case scenarios for the spill.

The White House office of management and budget, which is a traditional clearing house for decisions, turned down the request, the report said, quoting interviews with administration officials.

The report, one of four released today by the commission, provides the most compelling evidence to date of direct attempts by the White House to spin the BP oil spill disaster.

The White House disputed the commission’s findings. “Senior government officials were clear with the public what the worst-case flow rate could be,” the acting director of the OMB, Jeffrey Zients and the NOAA adminstrator, Jane Lubchenco, said in a statement.

The commission report does not explore why the White House sought to block the worst-case scenarios for the spill.

Scientists Found 40-Fold Increase In Carcinogenic Compounds In Gulf

(Sept. 30) — Researchers testing the waters off Louisiana in June found hugely elevated levels of polycyclic aromatic hydrocarbons, or PAHs, some of which are known carcinogens.

The researchers from Oregon State University say that a device taking samples just off the shore of Louisiana’s Grande Isle registered a 40-fold increase in PAHs between May and June.

What’s worse is that the sampling device was specifically designed to measure the fraction of PAHs in the environment that could make their way through a biological membrane.

“This is a measure of what would enter into an organism,” said Kim Anderson, an OSU professor of environmental and molecular toxicology.

“There was a huge increase of PAHs that are bio-available to the organisms — and that means they can essentially be uptaken by organisms throughout the food chain.”

The latest satellite data establishes that the North Atlantic Current (also called the North Atlantic Drift) no longer exists and along with it the Norway Current. These two warm water currents are actually part of the same system that has several names depending on where in the Atlantic Ocean it is. The entire system is a key part of the planet’s heat regulatory system; it is what keeps Ireland and the United Kingdom mostly ice free and the Scandinavia countries from being too cold; it is what keeps the entire world from another Ice Age. This Thermohaline Circulation System is now dead in places and dying in others.

This ‘river’ of warm water that moves through the Atlantic Ocean is called, in various places, the South Atlantic Current, the North Brazil Current, the Caribbean Current, the Yucatan Current, the Loop Current, the Florida Current, the Gulf Stream, the North Atlantic Current (or North Atlantic Drift) and the Norway Current.

The thermohaline circulation is sometimes called the ocean conveyor belt, the great ocean conveyor, or the global conveyor belt.

It is a university level physics experiment to use a tub of cool water and inject a colored stream of warm water into it. You can see the boundary layers of the warm water stream. If you add oil to the tub it breaks down the boundary layers of the warm water stream and effectively destroys the current vorticity . This is what is happening in the Gulf of Mexico and in the Atlantic Ocean.

The entire ‘river of warm water’ that flows from the Caribbean to the edges of Western Europe is dying due to the Corexit that the Obama Administration allowed BP to use to hide the scale of the BP Deepwater Horizon Oil Disaster. The approximately two million gallons of Corexit, plus several million gallons of other dispersants, have caused the over two hundred million gallons of crude oil, that has gushed for months from the BP wellhead and nearby sites, to mostly sink to the bottom of the ocean. This has helped to effectively hide much of the oil, with the hopes that BP can seriously reduce the mandated federal fines from the oil disaster. However, there is no current way to effectively ‘clean up’ the bottom of the Gulf of Mexico, which is about half covered in crude oil. Additionally, the oil has flowed up the East Coast of America and into the North Atlantic Ocean, and there is no way to effectively clean up this ‘sea bottom oil’. It is likely, based on numerous reports, that the oil is still flowing in massive amounts from multiple places on the seabed floor. This effectively means, that even if we had the technology in place to somehow clean up the free flowing thick crude oil deep in the ocean, it would likely not be enough to reverse the damage to the Thermohaline Circulation System in the Atlantic Ocean.
