Senate Wants the Military to Lock You Up Without Trial (Wired, Dec. 1, 2011):

Here’s the best thing that can be said about the new detention powers the Senate has tucked into next year’s defense bill: They don’t force the military to detain American citizens indefinitely without a trial. They just let the military do that. And even though the leaders of the military and the spy community have said they want no such power, the Senate is poised to pass its bill as early as tonight.

There are still changes swirling around the Senate, but this looks like the basic shape of the 2012 National Defense Authorization Act. Someone the government says is “a member of, or part of, al-Qaida or an associated force” can be held in military custody “without trial until the end of the hostilities authorized by the Authorization for Use of Military Force.” Those hostilities are currently scheduled to end the Wednesday after never. The move would shut down criminal trials for terror suspects.

But far more dramatically, the detention mandate to use indefinite military detention in terrorism cases isn’t limited to foreigners. It’s confusing, because two different sections of the bill seem to contradict each other, but in the judgment of the University of Texas’ Robert Chesney — a nonpartisan authority on military detention — “U.S. citizens are included in the grant of detention authority.”

An amendment that would limit military detentions to people captured overseas failed on Thursday afternoon. The Senate soundly defeated a measure to strip out all the detention provisions on Tuesday.

So despite the Sixth Amendment’s guarantee of a right to trial, the Senate bill would let the government lock up any citizen it swears is a terrorist, without the burden of proving its case to an independent judge, and for the lifespan of an amorphous war that conceivably will never end. And because the Senate is using the bill that authorizes funding for the military as its vehicle for this dramatic constitutional claim, it’s pretty likely to pass.

Lindsey Graham explained in plain language on the Senate floor: “…1031, the statement of authority to detain, does apply to American citizens and it designates the world as the battlefield, including the homeland.”

That means America, for those of you who are still wondering what “homeland” means. It’s a phrase borrowed from Nazi Germany, of course, which is the source of much of this legislation as you might have noticed.

WASHINGTON — The Senate voted Tuesday to keep a controversial provision to let the military detain terrorism suspects on U.S. soil and hold them indefinitely without trial — prompting White House officials to reissue a veto threat.

The measure, part of the massive National Defense Authorization Act, was also opposed by civil libertarians on the left and right. But 16 Democrats and an independent joined with Republicans to defeat an amendment by Sen. Mark Udall (D-Colo.) that would have killed the provision, voting it down with 61 against, and 37 for it.

“I’m very, very, concerned about having U.S. citizens sent to Guantanamo Bay for indefinite detention,” said Sen. Rand Paul (R-Ky.), one of the Senate’s most conservative members.

Question:  Dr. Roberts,  the United States is regarded as the most successful state in the world today. What is responsible for American success?

Dr. Roberts:  Propaganda. If truth be known, the US is a failed state. More about that later. The US owes its image of success to: (1) the vast lands and mineral resources that the US “liberated” with violence from the native inhabitants, (2) Europe’s, especially Great Britain’s, self-destruction in World War I and World War II, and (3) the economic destruction of Russia and most of Asia by communism or socialism.

After World War II, the US took the reserve currency role from Great Britain. This made the US dollar the world money and permitted the US to pay its import bills in its own currency. World War II’s destruction of the other industrialized countries left the US as the only country capable of supplying products to world markets. This historical happenstance created among Americans the impression that they were a favored people. Today the militarist neoconservatives speak of the United States as “the indispensable nation.”  In other words, Americans are above all others, except, of course, Israelis.

To American eyes a vague “terrorist threat,” a creation of their own government, is sufficient justification for naked aggression against Muslim peoples and for an agenda of world hegemony.

This hubristic attitude explains why among most Americans there is no remorse over the one million Iraqis killed and the four million Iraqis displaced by a US invasion and occupation that were based entirely on lies and deception. It explains why there is no remorse among most Americans for the countless numbers of Afghans who have been cavalierly murdered by the US military, or for the Pakistani civilians murdered by US drones and “soldiers” sitting in front of video screens. It explains why there is no outrage among Americans when the Israelis bomb Lebanese civilians and Gaza civilians.  No one in the world will believe that Israel’s latest act of barbarity, the murderous attack on the international aid flotilla to Gaza, was not cleared with Israel’s American enabler.

Question:  You said that the US was a failed state. How can that be? What do you mean?

Roberts:  The war on terror, invented by the George W. Bush/Dick Cheney regime, destroyed the US Constitution and the civil liberties that the Constitution embodies. The Bill of Rights has been eviscerated. The Obama regime has institutionalized the Bush/Cheney assault on American liberty. Today, no American has any rights if he or she is accused of “terrorist” activity. The Obama regime has expanded the vague definition of “terrorist activity” to include “domestic extremist,” another undefined and vague category subject to the government’s discretion.  In short, a “terrorist” or a “domestic extremist” is anyone who dissents from a policy or a practice that the US government regards as necessary for its agenda of world hegemony.

Unlike some countries, the US is not an ethic group. It is a collection of diverse peoples united under the Constitution. When the Constitution was destroyed, the US ceased to exist. What exists today are power centers that are unaccountable. Elections mean nothing, as both parties are dependent on the same powerful interest groups for campaign funds. The most powerful interest groups are the military/security complex, which includes the Pentagon, the CIA, and the corporations that service them, the American-Israel Public Affairs Committee, the oil industry that is destroying the Gulf of Mexico, Wall Street (investment banks and hedge funds), the insurance companies, the pharmaceutical companies, and the agri-companies that produce food of questionable content.

These corporate powers comprise an oligarchy that cannot be dislodged by voting. Ever since “globalism” was enacted into law, the Democrats have been dependent on the same corporate sources of income as the Republicans, because globalism destroyed the labor unions. Consequently, there is no difference between  the Republicans and Democrats, or no meaningful difference.

(NaturalNews) Even if Obama’s health care reform bill becomes law, mandating that all Americans buy health insurance policies for a failed system of “sick care”, I will refuse to comply. I’ve read the U.S. Constitution and its Bill of Rights, and nowhere in that document do I find that the federal government has the power to force consumers to purchase for-profit insurance products from private companies.

The very basis of the health care reform bill is, at its core, unconstitutional. If this mandate is allowed to stand, it sets a dangerous precedent for the U.S. government to require us to purchase other products and services from whatever industries it chooses to support. What’s next? Will the government pass a law forcing us to buy pharmaceuticals at thousands of dollars a year? Will it force us to purchase U.S.-made automobiles in order to boost the automobile industry? Is our economic free choice now centrally planned by our own government operating like Communist China?

This is a serious question that Constitutional scholars will no doubt be debating in the months ahead. But who am I kidding anyway? The U.S. government has long since abandoned the U.S. Constitution and no has any intention of abiding by it. Want proof? Read just one amendment: the 10th amendment.

The existence of a previously secret injunction against the media by oil traders Trafigura can now be revealed.

Within the past hour Trafigura’s legal firm, Carter-Ruck, has withdrawn its opposition to the Guardian reporting proceedings in parliament that revealed its existence.

Labour MP Paul Farrelly put down a question yesterday to the justice secretary, Jack Straw. It asked about the injunction obtained by “Trafigura and Carter-Ruck solicitors on 11 September 2009 on the publication of the Minton Report on the alleged dumping of toxic waste in the Ivory Coast, commissioned by Trafigura”.

“To ask the Secretary of State for Justice what assessment he has made of the effectiveness of legislation to protect (a) whistleblowers and (b) press freedom following the injunctions obtained in the High Court by (i) Barclays and Freshfields solicitors on 19 March 2009 on the publication of internal Barclays reports documenting alleged tax avoidance schemes and (ii) Trafigura and Carter-Ruck solicitors on 11 September 2009 on the publication of the Minton report on the alleged dumping of toxic waste in the Ivory Coast, commissioned by Trafigura.”

Alan Rusbridger, the Guardian editor, welcomed the move. He said: “I’m very pleased that common sense has prevailed and that Carter-Ruck’s clients are now prepared to vary this draconian injunction to allow reporting of parliament. It is time that judges stopped granting ‘super-injunctions’ which are so absolute and wide-ranging that nothing about them can be reported at all.”

At Westminster earlier today urgent questions were tabled by the Liberal Democrats in an attempt to get an emergency debate about the injunction.

Bloggers were active this morning in ‘speculating’ (Bloggers came up with the correct answer, which pressed the UK censorship into allowing the Guardian to report it now.) about what lay behind the ban on the Guardian reporting parliamentary questions. Proposals being circulated online included plans for a protest outside the offices of Carter-Ruck.

Press TV:We hear that Michael Mukasey is going to become the latest of the President’s Attorney-Generals to be subpoenaed, this time over his conversations with Bush and Cheney – does this show that Congress is serious about calling the executive to account?

Gore Vidal: No, Congress has never been more cowardly, nor more corrupt. All Bush has do is to make sure certain amounts of money go in the direction of certain important congressmen and that’s end of any serious investigation. After all, one of the bravest members of Congress is Dennis Kucinich who brought the article of impeachment in to the well of the House of Representatives. The House of Representatives must then try the president, and then after that it goes to the Senate for judgment. However, none of these things will happen because there’s nobody there except for Mr. Kucinich who has the courage to take on a sitting president who is kind of a Mafioso.

Press TV: How can it just be one person among so many hundreds of Congressmen who wants the impeachment of George W. Bush in these circumstances?

Gore Vidal: Well it’s because we no longer have a country. We don’t have a republic any more. During the last 7 or 8 years of the Bush regime, they’ve got rid of the Bill of Rights, they’ve got rid of habeas corpus. They have got rid of one of the nicest gifts that England ever left us when they went away and we ceased to be colonies – the Magna Carta – from the 12th century. All of our law and due process of law is based on that. And the Bush people got rid of it. The president and little Mr. Gonzales who for a few minutes was his Attorney General. They managed to get rid of all of the constitutional links that made us literally a republic.

Press TV: You have often written about the US’s superpower status in terms of the history of previous superpowers. Do you think we’re witnessing the end of US power as some suggest. Will the White House be seen like Persepolis?

Gore Vidal: Well it won’t make such good ruins, no. It’ll be more like the tomb of Cyrus nearby. They managed to destroy the United States – why? Because they’re oil and gas people and they’re essentially criminals. I repeat that this is a criminal group that’s seized control of the country through what looked like an ordinary election. But there’s some very nice films and documentaries about what happened in the year 2000 when Albert Gore won the election for president and they saw to it that he couldn’t serve. They got the Supreme Court – which is the Holy of Holies ordinarily in our system – to investigate and then accuse the thieves of being absolutely correct and the winners – Mr. Gore and the Democrats – of being the cheaters. It’s the first law of Machiavelli, whatever your opponent’s faults are, you pick his virtues and you deny he has them. That’s what they did when Senator Kerry ran a few years ago for president. He’s a famous hero from the Vietnam War. They said he was a coward and not a hero. That’s how it’s done. When you have a bunch of liars in charge of your government you can’t expect to get much history out of that. But later on we’ll dig and dig… and we will dig up Persepolis.

Press TV: Senator Obama talks about change but of course he has courting Wall Street as well as the Israeli lobby – do you see any prospect of change with him as president?

Gore Vidal: Not really. I don’t doubt his good faith, just as I do not doubt the bad faith of Cheney and Bush. They are such dreadful people that we’ve never had in government before. They would never have risen unless they were buying elections as they did in Florida in 2000, as they did in the State of Ohio in 2004. These are two open thefts of the Presidency. When I discovered that this did not interest the New York Times or the Washington Post or any of the press of the country I realized our day was done. We are no longer a country we are a framework for crooks to go in and steal money. Knowing that they’ll never be caught and they’ll be admired for it. Americans always take everybody on his own evaluation. You say I’m a state and they say “oh, yeah yeah yeah, he’s a state, isn’t that great.” And you accuse the other people of your crimes before you commit them. It’s an old trick which was known to Machiavelli who wrote about it in his handbook, the Prince.

Press TV:Finally that issue which is exercising so many minds in the Middle East and beyond. You, yourself have written about so many Imperial wars of the United States. Do you think Bush and Cheney would risk another war in what Mohammad ElBaradei of the IAEA calls a fireball?

Gore Vidal: They are longing to but they have spent all of the money. They have got it in their own private companies like the Vice-President and a company called Halliburton which is stealing more money and should be on trial sooner or later before Congress. But perhaps not, who knows? But it’s well known in Washington, these people are leaking away the money of the country. Well there’s no more money. They are longing for a war with Iran. Iran is no more a harm to us than was Iraq or Afghanistan. They invented an enemy, they tell lies, lies, lies.
The New York Times goes along with their lies, lies, lies. And they don’t stop. When the public that’s lied to 30 times a day it’s apt to believe the lies, is not it?

Bush Given Authority To Sexually Torture American Children

Slamming the final nail in the coffin of everything America used to stand for, the boot-licking U.S. Senate last night gave President Bush the legal authority to abduct and sexually mutilate American citizens and American children in the name of the war on terror.

There is nothing in the “detainee” legislation that protects American citizens from being kidnapped by their own government and tortured.

Yale Law Professor Bruce Ackerman states in the L.A. Times, “The compromise legislation….authorizes the president to seize American citizens as enemy combatants, even if they have never left the United States. And once thrown into military prison, they cannot expect a trial by their peers or any other of the normal protections of the Bill of Rights.”

Similarly, law Professor Marty Lederman explains: “this [subsection (ii) of the definition of ‘unlawful enemy combatant’] means that if the Pentagon says you’re an unlawful enemy combatant — using whatever criteria they wish — then as far as Congress, and U.S. law, is concerned, you are one, whether or not you have had any connection to ‘hostilities’ at all.”

We have established that the bill allows the President to define American citizens as enemy combatants. Now let’s take it one step further.

Before this article is dismissed as another extremist hyperbolic rant, please take a few minutes out of your day to check for yourself the claim that Bush now has not only the legal authority but the active blessings of his own advisors to torture American children.

The backdrop of the Bush administration’s push to obliterate the Geneva Conventions was encapsulated by John “torture” Yoo, professor of law at Berkeley, co-author of the PATRIOT Act, author of torture memos and White House advisor.

During a December 1st debate in Chicago with Notre Dame professor and international human rights scholar Doug Cassel, John Yoo gave the green light for the scope of torture to legally include sexual torture of infants.

Cassel: If the president deems that he’s got to torture somebody, including by crushing the testicles of the person’s child, there is no law that can stop him?

Yoo: No treaty.

Cassel: Also no law by Congress — that is what you wrote in the August 2002 memo…

Yoo: I think it depends on why the President thinks he needs to do that.
