Fact check: Texas has both the legal and moral right to secede from a corrupt union (Natural News, Nov 15, 2012):

The reaction to my recent article on why Texas is uniquely positioned to secede from the union and run itself as an independent nation state reveals that very few people on the internet have any real knowledge of history. (Gee, is anyone surprised that people on Facebook have no clue what they’re talking about?)

For the purpose of educating those who simply don’t know these facts, I’m publishing selections from the Texas state constitution that make it perfectly clear: Texas voluntarily joined the union but did not surrender power to the union. It reserves the eternal right to run its own affairs.

From the Texas Constitution, article 1, section 1:

“Texas is a free and independent State, subject only to the Constitution of the United States…”

As TexasSecede.com points out: Note that it does not state “…subject to the President of the United States…” or “…subject to the Congress of the United States…” or “…subject to the collective will of one or more of the other States…”

This means Texas has loyalty only to the Constitution, and when the federal government abandons the Constitution, Texas has no obligation, moral or legal, to recognize any government that has betrayed the law of the land (the Constitution and its Bill of Rights).

Also from the Texas Constitution:

All political power is inherent in the people … they have at all times the inalienable right to alter their government in such manner as they might think proper.

From the Texas Declaration of Independence:

When a government has ceased to protect the lives, liberty and property of the people, from whom its legitimate powers are derived…[it is] the inherent and inalienable right of the people to… abolish such government, and create another in its stead…

From the U.S. Declaration of Independence:

….governments derive their just powers from the consent of the governed…

…whenever any form of government becomes destructive to these ends [i.e., protecting life, liberty, and property], it is the right of the people to alter or to abolish it, and to institute new government…

…when a long train of abuses and usurpations… evinces a design to reduce them under absolute despotism, it is their right, it is their duty, to throw off such government, and to provide new guards for their future security.

For those ignorant people who say this is “treason,” the reality is that the current federal government is treasonous in its routine violations of the U.S. Constitution and the Bill of Rights! What could be more treasonous than signing the NDAA (Obama) which denies Americans their Fourth Amendment right to due process?

Americans are hopelessly ignorant about the source of government power

Far too many Americans today are ignorant about true history. They literally believe that government is God and that the President must be worshipped and obeyed no matter how insane his actions or his violations of the U.S. Constitution. This is factually incorrect: All government power comes from the People and is granted by the People, and may therefore be revoked by the People if the actions of government betray the People.

The truth of the matter is that the U.S. federal government has no legitimacy today. As it abandoned the limits of government set forth by the U.S. Constitution, it destroyed its own legitimacy. The federal government that operates today in Washington D.C. exists only as a criminal gang that demands obedience only by threatening violence against the People and by threatening to murder Americans with secret kill lists. All due process has been stripped from the People thanks to Obama’s signing of the NDAA.

The federal government recognizes NO limits of its own power and believe that states have no rights whatsoever. In essence, Obama believes he is a dictator, and his followers believe he should be dictator! “He gave us a phone,” after all!

This is a very frightening situation because as history shows, a population that is routinely suppressed, denied its civil liberties, kept economically impoverished and subjected to irrational and unlawful demands will sooner or later rise up against its own government and institute a new form of government. Unless, of course, they are Obama cultists in which case they will worship economic slavery and oppression, begging for more government tyranny and abuse of civil liberties.

  1. I agree that Texas has a moral and legal right to secede, and will debate anyone on that legality in any public forum. However, the more pertinent question is; Can it be morally acceptable to use any document signed 150 years ago at the point of a bayonet, or a tainted court decision more than a century and a half old, or a Presidential proclamation from the same time, as sound reason to hold a people who have freely expressed a desire for Independence?
    More than 30 countries have “seceded” from other countries in the past two decades and the U.S. has recognized the Independence of every one of them! It would be very difficult, in light of this, to convince the world they now had ligitimate right to hold Texas by force of arms!

I have known this all along. 8th grade Texas history made it a point for all our class to know this fact and that we are the only state with provision made within our charter when we joined the union of states to be able to secede if a the people felt it in the better interest of the state of Texas to do so….
