Victims of the Gulf of Mexico oil disaster won’t be able to sue BP or any of the other companies involved with the Deepwater Horizon rig if they accept a final payment from BP’s $20bn (£12.6bn) compensation fund.

The new rules are in a 12-page document posted on the website for the Gulf Coast Claims Facility.

The 90-day period in which the fund made emergency payments ended on Tuesday. But spill victims filing for these payments retained their legal right to sue BP.

Kenneth Feinberg, a Washington attorney overseeing the fund, said he had received 450,000 applications for emergency payments and that more than half had been filed within the past six weeks.

“That’s about four times what I thought they’d be,” he said. “It’s unheard of. Unprecedented. There’s never been anything like this in American history.”

However, he believes more than half of these claims will be rejected.

When all the emergency payments have been made, about $2.3bn will have been paid to 175,000 people, he added.

Meanwhile, those seeking to lodge claims now have a decision to make. They can accept a lump sum and relinquish their right to sue, or opt to accept interim payments. Interim payments will be made quarterly, and those receiving such pay-outs would retain their right to sue and continue to receive interim payments until they decide to accept a final payment, Mr Feinberg said.

Feinberg said he is also creating an appeals process for claimants for those who disagree with their final payment.

AP IMPACT: Fed’l Inspections on Rig Not as Claimed:

The federal agency responsible for ensuring that an oil rig in the Gulf of Mexico was operating safely before it exploded last month fell well short of its own policy that inspections be done at least once per month, an Associated Press investigation shows.

Since January 2005, the federal Minerals Management Service conducted at least 16 fewer inspections aboard the Deepwater Horizon than it should have under the policy, a dramatic fall from the frequency of prior years, according to the agency’s records.

Gulf of Mexico: Scientists Find Giant Plumes of Oil as Large as 10 Miles Long, 3 Miles Wide And 300 Feet Thick in Deep Waters:

Scientists studying video of the gushing oil well have tentatively calculated that it could be flowing at a rate of 25,000 to 80,000 barrels of oil a day. The latter figure would be 3.4 million gallons a day.

“The Gulf of Mexico is a very big ocean. The amount of volume of oil and dispersant we are putting into it is tiny in relation to the total water volume.”

Approximately 325,000 gallons of dispersant have been deployed so far in BP’s effort to break up the spreading oil slick before it hits the fragile Gulf coast, and over 500,000 gallons more are available.
